Analysis of the Legal Regulation of the Use of Renewable Energy Sources in the Energy Law of New Members of the BRICS Intergovernmental Association

Abstract

The energy industry (including the use of renewable energy sources (RES)) is one of the most promising and investment-worthy areas at both national and global levels. For the member states of the BRICS intergovernmental association, this economy sector is also a platform for cooperation and interaction. On January 1, 2024, six new countries joined the association as full members: Saudi Arabia, the UAE, Iran, Ethiopia, Egypt, and Argentina. This article analyzes the national legal regulation of the use of renewable energy sources in these states. It should be noted that all members of the association have major differences in their technical and economic development, as well as in their statutory regulation of the energy sector in general and renewable energy sources in particular. However, these circumstances only substantiate the need to study the legal regulation experience of the BRICS member states. It should be said that the use of RES in the selected states is subject to government regulation, the parties to public relations associated with RES use, the legal status of RES-based electricity markets and power facilities have been defined, legal requirements for foreign investment in RES projects, etc. have been established. Thus, the analysis conducted focuses on promising legal measures that can be implemented in the national laws in order to improve and update it, as well as contribute to the international legal harmonization efforts.

1 Как известно, БРИКС представляет собой межгосударственное объединение пяти государств, образованное в 2006 году в рамках Петербургского экономического форума. Согласно результатам саммита БРИКС, проведенного в августе 2023 года, с 1 января 2024 года в качестве полноценных членов в межгосударственного объединения входят новые шесть государств, а именно Саудовская Аравия, ОАЭ, Иран, Эфиопия, Египет и Аргентина [1].
2 Энергетика выступает важнейшей отраслью и неотъемлемой сферой обсуждения и сотрудничества, как на национальном, так и на международном уровне, в рамках деятельности БРИКС. Так, декларацией, принятой в 2019 году в Бразилии, закрепляется, что энергетические стратегии стран объединения подтверждают свою взаимодополняемость, открывая возможности для расширения энергетического сотрудничества внутри БРИКС в целях укрепления внутренней и глобальной энергетической безопасности и стимулирования экономического роста [2].
3 Разумеется, государства БРИКС имеют существенные различия по уровню энергетической самообеспеченности, структуре топливно-энергетического баланса, уровню развития энергетической инфраструктуры, организационным моделям внутренних энергетических рынков. Однако данные обстоятельства, напротив, подтверждают необходимость изучения опыта (в том числе государственно-правового) и сотрудничества в указанной области общественных отношений.
4 В целях полноценного сотрудничества и создания взаимовыгодных условий в энергетики (включая ВИЭ) создана Платформа энергетических исследований БРИКС [3], призванная содействовать устойчивому развитию энергетики посредством сотрудничества в области энергетических исследований, технологий, инноваций, развивать широкий диалог в целях обеспечения всеобщего доступа к недорогим, надежным и устойчивым энергоресурсам, укрепления энергетической безопасности стран БРИКС и обеспечения более широкой поддержки БРИКС в глобальных дискуссиях по энергетическим проблемам.
5 Учитывая также, что энергетическая область в целом, а возобновляемые источники энергии, в частности, выступают одной из актуальных и инвестиционно выгодных экономических отраслей, изучение правового опыта анализируемой области не вызывает сомнений.
6 В соответствии со статистической информацией (на 2022 год) доля стран БРИКС в общемировом производстве электроэнергии составляет 42%, в глобальной возобновляемой энергетике – 43% [4].
7 Кроме того, результаты проведенного сравнительно-правового исследования законодательств стран - членов БРИКС могут быть использованы и в целях дельнейшего развития правового регулирования использования возобновляемых источников энергии в Российской Федерации и проведения работы по международно-правовой унификации [5].
8 Остановимся подробнее на особенностях правового обеспечения использования возобновляемых источников энергии для вновь принятых государств-участников БРИКС.
