Abstract

The occurrence of accidents at electric power facilities and power receivers has a significant impact on the quality of energy supply to electricity consumers, the functioning of the fuel and energy complex, the socio-economic development of the country and national security. The attainment of the objective of the electric power industry specified in the Energy Strategy for the period up to 2035 and the implementation of the general principles and objectives of regulating reliability and safety in the electric power industry and the quality of electricity established in the Electric Power Industry Law is impossible without the development, adoption and timely updating of regulations governing the procedure for investigating the causes of accidents in the electric power industry. Previously, issues related to the regulation of the procedure for investigating the causes of accidents in the electric power industry were not considered in legal studies, with the exception of certain procedural issues in judicial practices in cases of appeal against investigation reports on the causes of accident. The purpose of the study is to establish the need to amend the legal regulation of the procedure for investigating the causes of accidents in the electric power industry and to form a concept for the development of the accident investigation procedure.

I. Значимость нормативного обеспечения процедуры расследования причин аварий в электроэнергетике
2 В рамках реализации Энергетической стратегии Российской Федерации на период до 2035 года (далее – Энергостратегия до 2035 года) повышение качества энергоснабжения потребителей является ключевой задачей электроэнергетики.
3 Решение этой задачи предполагает совершенствование отраслевой системы контроля деятельности организаций электроэнергетики по подготовке и надежному прохождению объектами электроэнергетики максимумов нагрузок, в том числе в целях снижения рисков возникновения аварий в энергосистемах.
4 Аварии на объектах электроэнергетики и энергопринимающих установках оказывают влияние на качество энергоснабжения потребителей электрической энергии, функционирование топливно-энергетического комплекса, социально-экономическое развитие страны и национальную безопасность.
5 Надежное и безопасное функционирование ЕЭС России и технологически изолированных энергосистем, доступность электрической энергии для потребителей, энергетическая и экологическая безопасность, приоритет обеспечения жизни и здоровья персонала на объектах электроэнергетики и энергопринимающих установках являются основными принципами и методами государственного регулирования и контроля в электроэнергетике в соответствии с Федеральным законом от 26.03.2003 № 35-ФЗ «Об электроэнергетике» (далее – ФЗ «Об электроэнергетике».
6 Государственное регулирование надежности и безопасности в сфере электроэнергетики и качества электрической энергии направлено на обеспечение устойчивого, надежного и безопасного функционирования отрасли, а также предотвращение возникновения аварийных ситуаций, связанных с эксплуатацией объектов электроэнергетики и энергетических установок.
7 Соответственно, решение указанной в Энергостратегии до 2035 года задачи электроэнергетики и реализация установленных ФЗ «Об электроэнергетике» общих принципов и целей регулирования надежности и безопасности в сфере электроэнергетики и качества электрической энергии невозможно без разработки, принятия и своевременной актуализации нормативных правовых актов, регламентирующих процедуру расследования причин аварий в электроэнергетике.
8 Установление в нормативных правовых актах алгоритма расследования причин аварий в электроэнергетике обеспечивает:

  • осуществление Ростехнадзором, собственниками, иными законными владельцами объектов электроэнергетики и (или) энергопринимающих установок либо эксплуатирующими их организациями всестороннего расследования причин технологических нарушений в рамках формально определенной процедуры расследования;

  • выявление недостатков при эксплуатации, проектировании, изготовлении оборудования, строительстве зданий и сооружений, приведших к аварии или инциденту; формирование субъектами электроэнергетики и потребителями электрической энергии плана профилактических мероприятий по предотвращению аналогичных технологических нарушений;
