Abstract

The main objective of the electric power industry is to provide for uninterrupted and reliable operation of power systems in order to meet the demand for electric power. The introduction of digital technologies in the wholesale electricity and capacity market is aimed at improving the efficiency, safety and continuity of its operation. The author highlights the features of legal support of digitalization in the wholesale electricity and capacity market, and proposes the possibility of expansion of the experimental legal regime to the wholesale electricity and capacity market. Information security issues are considered taking into account the fact that market participants may suffer not only financial and reputational losses from the implementation of security threats, but also damage to the life and health of people, the environment and the market infrastructure. The author concludes that it is necessary to develop means of legal protection of interests of owners and users of electronic software systems, as well as legal regulation of automated actions carried out in the wholesale electricity and capacity market. The research was carried out with the financial support of the RFBR within scientific project No. 20-311-90034.

Введение
2 Импульсом для всеобъемлющего внедрения информационных технологий стало издание ряда документов стратегического планирования, реализация которых должна повлечь повышение уровня цифровизации в ближайшее десятилетие. Указом Президента РФ от 7 мая 2018 года № 204 определено, что при реализации национальной Программы «Цифровая экономика Российской Федерации» необходимо уже к 2024 году обеспечить создание системы правового регулирования цифровой экономики. Тренд по цифровизации энергетики также был поддержан в Энергетической стратегии Российской Федерации до 2035 года. А.Г. Лисицын-Светланов верно указывает, что для эффективной правовой политики необходим системный подход, сочетающий принятие актов публичного и частного права, а также обеспечение правом баланса частных и публичных интересов. Выполнение этих условий необходимо для энергетического права — центрального звена регулирования в сфере энергетики [1]. Исследуя вопросы правового обеспечения энергетической безопасности, В.В. Романова отмечает, что для решения стратегических задач развития энергетической отрасли необходимо разработать правовую базу, на основании которой будет осуществляться использование цифровых технологий при учете добытых, произведенных, поставленных, переданных, транспортируемых, хранящихся энергетических ресурсов, функционирование энергетических систем и объектов, деятельность и взаимодействие участников энергетических рынков, в договорном регулировании и при рассмотрении споров, и подчеркивает, что целесообразно проведение фундаментальных исследований проблем правового регулирования использования цифровых технологий для разработки научных положений, на основе которых может осуществляться формирование и функционирование системы правового регулирования применения цифровых технологий в сфере энергетики [2].
3 Во исполнение вышеуказанных документов стратегического планирования Минэнерго России реализуется ведомственный проект «Цифровая энергетика», в 2019 году создан Совет по цифровой трансформации ТЭК, а в начале 2020 года в Минэнерго России создан центр компетенций по цифровому развитию в энергетике (Департамент информационного обеспечения и цифровой трансформации ТЭК). Поэтапно вводится в эксплуатацию Государственная информационная система топливноэнергетического комплекса (ГИС ТЭК), запуск которой состоялся в октябре 2019 года. Со стороны Минкомсвязи были представлены рекомендации по масштабной цифровой трансформации в государственных корпорациях и компаниях с госучастием [3], что особенно актуально для субъектов оптового рынка электроэнергии.
4 Участниками рынка, в свою очередь, разрабатываются и принимаются локальные нормативные акты по вопросам цифровизации деятельности: Комплексная целевая программа развития единого информационного пространства Группы «Газпром», Концепция «Цифровая трансформация 2030», принятая ПАО «Россети», Единая цифровая стратегия Госкорпорации «Росатом», Стратегия развития Группы «Интер РАО» на период до 2025 года с перспективой до 2030 года. АО «Концерн Росэнергоатом», АО «Интер РАО — Электрогенерация», АО «СО ЕЭС» и АО «НИЦ ЕЭС» учреждена Ассоциация «Цифровая энергетика» [4].
