Goals of Further Development of Legal Regulation in Heat Supply and Protection of Rights of Players in the Heat Energy Market in the Constitutional Court of the Russian Federation

Abstract

A certain legal base that regulates public relations in the heat power industry has currently been formed. However, representatives of legislative authorities, government agencies, and the expert community note that it is advisable to improve the regulatory framework in heat supply and, above all, legal regulation of accident-free operation of heat supply and network facilities. Legal analysis of provisions of the current laws in the field of heat supply, debating points arising upon consideration of draft laws, and court practice indicate presence of inaccuracies, gaps, and contradictions that need to be addressed, and great work needs to be done to this end. The need to work to improve legal regulation in heat supply is also confirmed by the Decree of the Constitutional Court of the Russian Federation. In 2018, two Decrees of the Constitutional Court of the Russian Federation were adopted (No. 30-П dated July 10, 2018, and No. 46-П dated December 28, 2018). According to them, the following provisions were found not to comply with the Constitution of the Russian Federation: Part 1, Article 157 of the Housing Code of the Russian Federation, the third paragraph, clause 42 of Regulation 354, and the second paragraph, clause 40 of Regulation 354.

Considering significant number of lawsuits in the field of heat supply, it seems very important to work on timely analysis of court practice and a more mobile response to cases when gaps in legal regulation are identified in order to prepare necessary addenda and amendments to existing regulatory legal acts to ensure a balance of interests of players in the heat energy market without waiting for the next acknowledgement of certain provisions of the laws in the heat supply industry non-complying with the Constitution of the Russian Federation.

1 В правовом регулировании общественных отношений в сфере теплоснабжения задействованы различные источники энергетического права, в том числе Конституция Российской Федерации, Гражданский кодекс, Жилищный кодекс Российской Федерации, Кодекс Российской Федерации об административных правонарушениях, Федеральный закон от 27.07.2010 № 190-ФЗ «О теплоснабжении», подзаконные нормативные правовые акты и т.д.
2 Ключевую роль в правовом регулировании общественных отношений в теплоэнергетике играет Федеральный закон от 27.07.2019 № 190-ФЗ «О теплоснабжении» (далее по тексту — Федеральный закон «О теплоснабжении»). Во исполнение Федерального закона «О теплоснабжении» в рамках предусмотренных законодателем полномочий Правительством Российской Федерации в том числе утверждены: требования к схемам теплоснабжения, к порядку их разработки и утверждения; правила организации теплоснабжения в Российской Федерации; Основы ценообразования в сфере теплоснабжения; Правила регулирования цен (тарифов) в сфере теплоснабжения; Правила подключения (технологического присоединения) к системам теплоснабжения, включая правила недискриминационного доступа к услугам по подключению (технологическому присоединению) к системам теплоснабжения; Правила недискриминационного доступа к услугам по передаче тепловой энергии, теплоносителя; Правила рассмотрения (урегулирования) споров и разногласий, связанных с установлением и (или) применением цен (тарифов). Кроме этого, отношения по теплоснабжению и предоставлению соответствующих коммунальных услуг регулируются Правилами предоставления коммунальных услуг собственникам и пользователям помещений в многоквартирных домах и жилых домов, утвержденными Постановлением Правительства Российской Федерации от 06.05.2011 № 354 (далее по тексту — Правила 354).
3 Работа по дальнейшему развитию правового регулирования в сфере теплоснабжения проводится и в соответствии с Распоряжением Правительства Российской Федерации от 29.11.2017 № 2655-р, которым утвержден план первоочередных мероприятий («дорожная карта») по внедрению целевой модели рынка тепловой энергии, направленный на реализацию Федерального закона от 29.07.2017 № 279-ФЗ «О внесении изменений в Федеральный закон «О теплоснабжении» и отдельные законодательные акты Российской Федерации по вопросам совершенствования системы отношений в сфере теплоснабжения».
4 Таким образом, на сегодняшний день сформирована определенная правовая база, регулирующая общественные отношения в сфере теплоэнергетики, однако на целесообразность совершенствования нормативно-правовой базы в сфере теплоснабжения, и прежде всего правового обеспечения безаварийной работы объектов теплоэнергетического и сетевого хозяйства, указывают представители законодательной власти, государственных органов, экспертного сообщества [1].
