Abstract

National security becomes a strong determining factor while implementing trade policy measures, and this raises many legal and political questions. The article shows that, historically, the United States, as a Contracting Party to GATT-47, experienced serious domestic difficulties in developing rules regarding security exceptions. The confrontation between the U.S. Department of State and War Departments, who were charged with post-war U.S. military and defense planning, left its mark of ambiguity in the wording of some trade rules. In recent years, Washington has been actively used trade restrictive measures, invoking articles on security exceptions in the World Trade Organization (WTO) rulebook. Panel report on the dispute “Russian Federation - measures in relation to transit of goods” contributed greatly to the interpretation of the relevant exceptions. At the same time, the definition of the “boundaries” of the use of such measures remains largely open. The urgency of the problem becomes even more evident when we note how the current discourse is shifting towards sources of national security problems other than military threats. In the long term, national security issues might be linked to food and energy security, and in the near future - to climate change. The deviation from the paradigm of multilateral liberalism towards economic nationalism requires a rethinking of the approaches laid down in the foundation of the multilateral trading system. The author concludes that the United States is not interested in clarifying the WTO rules related to national security, while maintaining the status quo, which allows it to have wide policy space.

1 Вопросы национальной безопасности всегда занимали особое место в торговой политике США. При администрации Д. Трампа они служили для обоснования введения односторонних дискриминационных мер в области торговли и инвестиций. Администрация Байдена–Харрис смягчила подход, но не отказалась от него. Продолжается разработка ключевого документа в этой сфере – Стратегии национальной безопасности (СНБ). Ви́дение Вашингтоном использования в торговом регулировании исключений по соображениям национальной безопасности оказывает влияние на деятельность Всемирной торговой организации (ВТО).

ЗАДАЧИ ТОРГОВОЙ ПОЛИТИКИ В СТРАТЕГИЧЕСКИХ ДОКУМЕНТАХ

3 В марте 2021 г. администрация президента США выпустила “Переходное стратегическое руководство по национальной безопасности” [1] (далее – Руководство). В нем представлено ви́дение по взаимодействию США с миром и заданы контуры политики страны в период, пока работа над СНБ не завершена. Хотя Руководство носит промежуточный характер, оно позволяет понять приоритеты в области национальной безопасности.
4 Во-первых, Вашингтон взял курс на максимально широкое толкование национальной безопасности. В документе говорится, что все большее значение будут играть кибербезопасность, проблемы трудовых стандартов1 и изменения климата. Подчеркивается, что национальная безопасность будет определяться и экономической безопасностью. 1. Более высокие трудовые стандарты и зарплаты в США по сравнению с другими странами негативно влияют на себестоимость и, соответственно, конкурентоспособность американских товаров. Вашингтон стремится отрегулировать разницу с помощью нетарифных инструментов торговой политики (в частности, вводя запреты, компенсирующие тариф или побуждая другие страны повысить свои стандарты).
5 Во-вторых, проявляется преемственность по отношению к положениям СНБ-2010 и СНБ-2015 по сохранению американского лидерства с опорой на многосторонние подходы, а также в понимании ограниченности возможностей такого лидерства. В частности, США признают, что невозможно одолеть “самонадеянный” Китай в одиночку, в тексте неоднократно высказывается идея расширения и углубления партнерских и союзнических отношений.
6 В-третьих, Байден продолжит курс Трампа на перенос в США цепочек поставок критически важных товаров.
7 В-четвертых, Руководство указывает на необходимость реформы ВТО, при этом не упоминается реформа Органа по разрешению споров2. Согласно Руководству, США в альянсе с единомышленниками будут реформировать ВТО, чтобы организация позволяла защищать права американских трудящихся, а также обеспечивала охрану окружающей среды, в том числе через переход к чистой энергетике. 2. Апелляционный орган (АО) ВТО не функционирует с 11 декабря 2019 г., поскольку истек срок полномочий членов АО, а назначение новых заблокировано США.
8 Наконец, документ резюмирует, что традиционные различия между внешней и внутренней политикой стираются. Национальная безопасность невозможна без экономической и экологической безопасности, а также охраны здоровья, в связи с чем увеличилась актуальность межведомственной координации.
9 Практически синхронно с публикацией Руководства была выпущена “Повестка в сфере торговой политики 2021” [2], которая отражает приоритетные направления работы аппарата Торгового представителя США (АТП) и детализирует основные идеи Руководства во внешнеэкономической плоскости. Среди них:
