Labor Migration Regulation Problems in Modern Russia

Abstract

There is no need today to prove the relevance of the problems of cross-border migration in general, and of labor in particular. It is significant that in this sphere, there are cardinal changes not only in the structure and intensity of flows, but also in the transformation of goals and objectives of migration policy, in organization of migration regulation systems on the part of the main receiving countries. The analysis of the relationship between the common characteristics of modern national systems of migration regulation and their specific national features is of particular interest – par excellence in the context of the transformation of the goals, objectives and methods of regulation of transnational migrant flows. It’s this, ultimately, that determines the effectiveness of activities, the ability to find adequate answers to new migration realities. In this sense, the Russian experience in the formation of a national model of migration regulation and development of a modern migration policy is of undoubted interest. The article discusses the current problems of labor migration regulation in Russia. A new Concept of the State Migration Policy of the Russian Federation through to 2025 has been adopted, which is an indicator of the change in priorities, goals and objectives of migration policy and the system of migration regulation. In addition, the new concept as a program document does not provide answers to a number of questions relating specifically to labor migration. This applies both to the ratio of supply and demand for foreign labor, and to the choice of more effective mechanisms for determining needs and ways to satisfy them. Today, in the regulation of labor migration (including visa) there are many problems that need to be resolved on the basis of program-targeted approaches.

1 Тема миграции привлекает в последнее время пристальное внимание как средств массовой информации, так и исследователей. И подобный интерес вполне обоснован не только серьезными последствиями европейского миграционного кризиса 2015–2016 гг., движением "караванов" беженцев из стран Центральной Америки в сторону границ США, но и главным образом необходимостью извлечения уроков, осмысления причин, механизмов и направлений трансформации миграционной политики принимающих стран именно в последнее время.
2 Трудовая миграция выступает базовым компонентом территориальной трансграничной мобильности, роль которой постоянно возрастает. По расчетам ООН, в 2017 г. из 234 млн мигрантов в трудоспособном возрасте (15+) 164 млн – трудовые мигранты. Это 59.2% всех трансграничных мигрантов, 70.1% мигрантов в трудоспособном возрасте и 4.7% – всех работников [1, pр. 5-7].
3 Анализ практик иммиграционного регулирования основных принимающих стран наглядно свидетельствует о смене приоритетов. Защита национальных рынков труда, борьба с нелегальной занятостью иммигрантов, привлечение четко артикулированных и конкретных категорий трудовых мигрантов, переход к циркулярным моделям временной трудовой миграции и предотвращение расползания угрозы терроризма выдвигаются на передний план.
4 Это сопровождается кардинальной трансформацией институтов иммиграционного регулирования, совершенствованием систем отбора и отсева претендентов на въезд.
5 В отечественной практике это проявляется не только через оживленную экспертную дискуссию по проблеме миграции, но главным образом через определение задач миграционной политики на среднесрочную перспективу. Смена векторов политики четко просматривается в "Концепции государственной миграционной политики Российской Федерации на 2019–2025 годы" [2]. По сравнению с Концепцией 2012 г. можно констатировать заметный прогресс в определении приоритетов, адекватных социально-экономической и политической ситуации, к которой стране предстоит адаптироваться в ближайшие годы.
6 Вместе с тем трансформация миграционной политики основных принимающих стран, все более целенаправленно акцентирующих роль трудовой миграции в повышении экономической конкурентоспособности, как представляется, не получила необходимого отражения в данном документе.
7 Как известно, система регулирования притока и использования иностранной рабочей силы (ИРС) в России включает три категории трудовых мигрантов: из них две безвизовых – граждане стран – членов ЕАЭС, приравниваемые к национальной рабочей силе, выходцы из прочих стран СНГ (работа на основе патента) и визовый поток трудовых мигрантов из третьих стран. Последняя категория включает как квотируемые категории трудовых мигрантов, так и высококвалифицированных специалистов, привлекаемых вне квоты.
