Assessment of Threats Related to Maritime Crimes in the Arctic

Abstract

Transnational crimes committed in the maritime domain pose a real threat to international security today. Climate change and opening of shipping routes in the Arctic actualize the need to assess this type of security threats for the polar region. While the official Arctic strategies of the five coastal states – Russia, Canada, Denmark, Norway and the USA, – in general, acknowledge threats to maritime security stemming from non-state organized criminal actors, there is neither system-based understanding of these threats, differentiated approach to assessing specific types of potential maritime criminal activities, nor developing practical measures aimed at their prevention and suppression. Basing on the analysis of different maritime crimes, it seems reasonable to ascertain a generally low probability of their large-scale emergence in the Arctic in the nearest future. Main reasons for that are severe climate conditions, as well as economic and political stability of the region. However, the apparent and anticipated increase of Arctic shipping and development of new types of economic activities, such as tourism, can lead to increased risks related to transnational maritime criminal activity in the Arctic. In this regard, to date, the most real threat is posed by such crimes as terroristic attacks on cruise ships, illegal transportation of drugs and weapons using the main Arctic marine routes, illegal migration. It is obvious that the Arctic coastal states lack sufficient resources to efficiently address the threats related to transnational maritime crimes. In this context, special focus should be made on enhancing regional interstate cooperation in the field. Taking into account that the only regional mechanism responsible for enhancing coordination of national bodies regarding security-related issues is the Arctic Coast Guard Forum, it would be reasonable to endow this institution with the competence to develop joint measures for the suppression of potential maritime criminal activities in the Arctic. This could be made through development of a pan-Arctic legally binding agreement that would specify practical measures stipulated by other international agreements in the field of suppressing certain types of maritime crimes.

1 Интенсификация экономической деятельности в Арктике, а также планы государств региона, в частности России, по развитию судоходства на арктических транспортных артериях увеличивают вероятность нарастания различных угроз морской безопасности невоенного характера. Одной из них является транснациональная террористическая и организованная преступная деятельность [1, p. 261]. В силу своей специфики, заключающейся в широкой разветвленности и глубокой замаскированности соответствующих групп, этот вид угроз не может быть устранен традиционными средствами обороны, к которым государства прибегают для защиты своих границ и населения. Морская среда, с учетом ее масштабов и наличия огромных неконтролируемых государствами пространств, а также значительной доли мировой экономики, завязанных на ее использование, особенно подвержена таким вызовам. Вместе с тем Арктика остается регионом с суровыми климатическими условиями и малочисленным населением, что, с одной стороны, является сдерживающим фактором для преступных групп, но, с другой – усложняет задачу предотвращения незаконных действий в случае их совершения. В этой связи представляется целесообразным дать оценку вероятности систематического совершения в Арктике таких преступлений, посягающих на морскую безопасность, как пиратство, морской терроризм, незаконная перевозка наркотиков и др.

Пиратство
3 Пиратство считается одним из самых древних преступлений, возникшим одновременно с судоходством [2, сc. 185-186]. Данный вид незаконной деятельности и сегодня представляет реальную угрозу безопасности на море. Пик пиратских нападений на морские суда в современной истории пришелся на 2010 г. В этот год было зафиксировано 445 нападений, из них 139 – на сомалийском побережье [3]. В последние годы наметилась тенденция к сокращению количества данного вида преступлений. За 2017 г. было совершено 180 попыток пиратских нападений [4], из которых большая часть совершена у побережья Индонезии (43) и Нигерии (33).
4 Существует множество дефиниций пиратства. Конвенция 1982 г. определяет его как “неправомерный акт насилия, задержание или любой грабеж, совершаемый с личными целями экипажем или пассажирами какого-либо частновладельческого судна или летательного аппарата и направленный против другого судна или летательного аппарата или против лиц и имущества, находящихся на борту”, совершенные в открытом море или “в месте вне юрисдикции какого бы то ни было государства” (ст. 101).
5 Международное морское бюро (ММБ) выработало более широкое определение пиратства – акт высадки на борт любого судна с намерением совершить грабеж или любое другое преступление, а также с намерением или возможностью использовать насилие в этих целях [2, c. 194]. В отличие от ст. 101 Конвенции 1982 г., данное определение включает акты вооруженного разбоя против судов в территориальном море, нападения на суда, стоящие на якоре, а также не ограничивает понятие пиратства конвенционным условием наличия, как минимум, двух судов, что позволяет причислять к нему нападения с маломерных лодок и на стоящие на приколе в порту суда. Такая широкая трактовка обусловлена тем, что большинство пиратских атак (до 75% [5]) совершается во внутренних водах или территориальных морях прибрежных государств.
