Abstract

The article analyzing the scientific legacy of S.V. Yushkov delves into the issue of continuity in the advancement of science, even during periods that appear to involve a complete disruption of the established paradigm.

The article aims to examine the pre-revolutionary traditions of historical and legal science that S.V. Yushkov, one of the pioneers of Soviet science in the field of the history of the state and law, followed in his scholarly endeavors. These traditions were not only supported by him but also further developed in his works.

The article identified the traditional approaches in historical-legal research that were developed in Russia before 1917, using the methods of analysis and synthesis. The utilization of the descriptive method facilitated the depiction of the traditions within historical-legal science that emerged in the Russian Empire. The chronological method was used to establish some biographical data of this outstanding Soviet scientist and the evolution of the main directions of his research. The comparative method was employed to identify the traditions of pre-revolutionary science in the history of law, which were occasionally evident and at times concealed in S.V. Yushkov’s works. By employing the diachronic approach, the evolution of objects in scientific research of S.V. Yushkov was determined, and the synchronic approach was employed to illustrate the general and specific aspects in the development of historical and historical-legal science in the USSR.

As a result, it was shown that the scientific heritage of S.V. Yushkov is a sort of a bridge between the pre-revolutionary and modern stages of the development of historical-legal science, since, on the one hand, he managed to preserve the best that was achieved by researchers of the Russian Empire, but at the same time he made a huge contribution to the study of state legal material from a positivist position. It has been concluded that scientists in the 21^st century have the ability and obligation to incorporate the accomplishments of legal historians from the pre-revolutionary and Soviet periods, while ensuring the continuity of scientific knowledge and methodology.
