Abstract

This study aims to examine the content and relationship between the fundamental concepts of "global legal order” and "global world order”, which are often perceived in doctrine as synonymous or closely related definitions (when scholars attribute specific qualitative global world order traits to the global legal order and vice versa), and at times mistakenly as terms denoting opposing phenomena.

The resolution of this issue is closely intertwined with the ongoing transformation of the world system (WS)and, above all, its political segment. As this transformation is dynamic, the concept of global world order aims to reflect the WS at a specific point in time (or brief period). Consequently, the content of the global world order continuously evolves alongside the WS. The global legal order arises from the implementation of fundamental jus cogens norms of general international law, which aim to establish the legal framework for the WS and essential international interstate relations. Thus, it is also linked to the transformation of theWS, albeit in a different manner. On the one hand, the transformations of the WS certainly have an impact on the state of the current global legal order, but they do not automatically entail its replacement: in the case when its basic regulatory framework retains its content, the global legal order remains the same. While changes in theWS may not always result in the replacement of one global legal order with another, the establishment of a new global legal order invariably necessitates a radical restructuring of theWS and, consequently, the global world order.

The set of used methodological approaches encompass a range of general scientific and specialized methods, including historical analysis, formal logic, analysis and synthesis.
