Abstract

The author of the article considers election observation as a form of public control provided by civil society to contribute to election legitimacy and to strengthen voters’ confidence in the election results as well as in the legality of the legislative branch.

The article analyzes the practice of video broadcasting of voting process, the cases of public observation done by public chambers at the elections to the State Duma in 2021.

The conclusion is made about the need to improve the legal regulation of public control at elections. The author proposes to appoint election observers in places of detention with this right to be realized by civic monitoring commissions. Since elections are a form of democracy, it is important to expand the possibility of public control in the federal legislation not only over the vote, but also at the previous stages of the electoral process federal legislation.

3	Общественное наблюдение на выборах автор статьи рассматривает как форму общественного контроля институтов гражданского общества за законностью выборов, способствующую укреплению доверия избирателей к итогам голосования, легитимности сформированной законодательной власти. В статье анализируется практика видеотрансляции голосования, организации общественного наблюдения общественными палатами на выборах в Государственную Думу в 2021 году. Делается вывод о необходимости совершенствования правового регулирования общественного контроля на выборах. Предлагается предоставить право назначения наблюдателей на голосовании в местах принудительного содержания граждан общественным наблюдательным комиссиям. Поскольку демократические выборы являются формой народовластия, важно расширить федеральным законодательством возможность общественного контроля не только за голосованием, но и на предыдущих стадиях избирательного процесса. 8	Демократические выборы органов публичной власти в строго определенном законом порядке создают предпосылки для легитимности публичной власти. Уже во время подготовки и проведения выборов формируется отношение избирателей к будущим органам публичной власти. Если избирательная кампания проходит гласно, законно и демократично под контролем институтов гражданского общества, то это вселяет надежду у избирателей, что их волеизъявление станет основой деятельности органов публичной власти по реализации интересов большинства граждан. Легитимации выборов способствует наблюдение. В избирательном законодательстве, равно как и в законодательстве об общественном контроле, не содержится легального определения понятия наблюдение. Однако его цель и порядок осуществления позволяют сделать вывод, что наблюдение представляет собой своеобразную форму общественного контроля за деятельностью избирательных комиссий. Как отмечает В.В. Гриб, общественный контроль за избирательным процессом «служит гарантией свободной реализации избирательных прав граждан, их соблюдение, гарантией свободного волеизъявления граждан в ходе выборов и референдума, а также созданию условий для признания результатов выборов и референдума действительными».¹	1.
