Abstract

A search, formulation, statistical confirmation, and analysis of patterns reflecting the relationship of criminal legislation with the social environment are undertaken. Explains the relationship between socio-psychological attitudes of the population and the level of repressive penal laws, between the rigidity of criminal law and liberal nature of the judicial practice, between the amount of criminalization and the "dead rules", between over-criminalization and law enforcement, between the latitude of the system of punishment and penal practice between criminalization shortcomings and negative social consequences.
