Abstract

The article deals with the historical and conceptual foundations that led Anglo-American (Anglo-Saxon) criminal procedure to the shaping of special sentencing hearing that is distinct in its legal regime from that of trial hearing where the issue of guilt is decided on. The author concludes on the basis of analysis of Russian and foreign legal and doctrinal sources that sentencing as a distinct stage of criminal proceedings is a relatively recent phenomenon that came into existence as a result of evolution of Anglo-American criminal justice in XVIII - XX centuries, coupled with the radical transformation of Criminal Law which required new mechanisms of its enforcement.
