Abstract

The Online Streaming Act and the Online News Act are two pieces of the government's digital agenda. They are separate pieces of legislation with different implementation processes. The Canadian Radio-television and Telecommunications Commission (CRTC) is responsible for the regulation of the laws. 

The Online Streaming Act received Royal Assent on April 27, 2023 and is the first major reform of the Broadcasting Act since 1991. It updates broadcasting policy for Canada and require online streaming services to contribute to the creation and availability of Canadian audio-visual contentin an equitable way. Online Streaming Act makes Canadian stories and music widely available to Canadians in the digital age. The law will give Canadians more opportunities to see themselves in what they watch and hear, under a new framework that better reflects Canada today.

The Online News Act received Royal Assent on June 22, 2023. It aims to ensure that dominant platforms compensate Canadian news businesses when their content is available on their services. The Act creates a bargaining framework to ensure that platforms compensate news businesses fairly. It encourages platforms to reach voluntary commercial agreements with a range of news businesses. If parties are not able to come to fair agreements independently, they would have to proceed to a mediated mandatory bargaining process. If, after mediation, the parties are still unable to reach an agreement, each party would submit a final offer, and an arbitral panel would choose one of the offers.

Введение

 

Одно из центральных мест правительственной стратегии в Канаде в последние годы занимает политика в области цифрового развития, процессы которого всё глубже проникают во все виды деятельности и глобально влияют на изменения жизни общества. Особое внимание со стороны государства уделяется вопросам регулирования в культурно-информационном пространстве. На первоначальном этапе правительство либералов сделало акцент на анализе места и роли канадского контента в условиях мирового цифрового пространства, выступив за оказание на разных уровнях государственной поддержки производству и распространению канадской культурной продукции в обстановке быстро меняющейся технологической реальности1.

В качестве следующего шага в 2018 году была начата процедура пересмотра законодательства в области регулирования сферы вещания и телекоммуникаций2. Реформа в этой области была предпринята впервые с 1991 года, со времени внесения поправок и дополнений к закону «О вещании» (Broadcasting Act). В итоге её завершения в 2023 году были приняты два закона: закон «Об онлайн-стриминге» и закон «Об онлайн-новостях», которые регулируют цифровую деятельность канадского культурно-информационного пространства.

Принятые законы – результат двух важнейших законодательных инициатив канадского правительства, которые, по его мнению, являются ключевыми составными частями политики цифрового развития. Третье направление в решении цифровой повестки связано с вопросами обеспечения безопасности в онлайн-пространстве3, а именно с подготовкой и введением в действие закона об угрозах в интернете, который в настоящее время находится в стадии разработки4.

Закон «Об онлайн-стриминге»

 

Работа над законопроектом, который впоследствии трансформировался в закон, началась после опубликования в январе 2020 года доклада «Будущее канадских коммуникаций: время действовать» (Canada's Communications Future: Time to Act)5. Доклад был подготовлен рабочей группой экспертов, созданной правительством Канады, с целью анализа возможных вариантов пересмотра законодательной базы в области вещания и телекоммуникаций. Один из главных выводов, по мнению авторов доклада, заключался в том, что сфера действия нового законодательства и государственного регулирования должна быть значительно расширена и распространена на все компании, независимо от национальной принадлежности, которые действуют на территории Канады как в традиционных сферах телекоммуникаций (радио, телевидение), так и в онлайн-пространстве.

5 Подготовленный в течение 2020 года первоначальный вариант законопроекта под номером С-10 был представлен в парламент в ноябре тогдашним министром канадского наследия Стивеном Жильбо (Steven Guilbeaut). 22 июня 2021 года закон был принят Палатой общин, но не дошёл до обсуждения в Сенате, так как парламент был распущен в связи с проведением федеральных выборов. Повторно закон (закон С-11), регулирующий сферу вещания в цифровом пространстве, был внесён на рассмотрение канадского парламента в феврале 2022 года, одобрен Палатой общин 21 июня и Сенатом 2 февраля 2023 года. После получения Королевской санкции (Royalassent) 27 апреля 2023 года закон вступил в силу.
