Abstract

The article discusses the problems of identification of human dignity in constitutional and philosophical legal discourse, examines the sociobiological nature and essence of dignity in modern constitutionalism and international jurisprudence; the origin and use of "dignitas" in the Roman legal tradition; the development of ideas about human dignity in the Renaissance and their impact on legal doctrines and modern practice of constitutional justice. The work assesses the prospects for the elevation of human dignity in modern jurisprudence from the perspective of philosophical and meta-legal analysis. The article substantiates why the word "dignity" occupies a central position in the contemporary ethical and legal debate. The aim of the article is to define the meaning and role of legal polymorphism in creating various legal forms of human dignity; the role of dialogue between European and Russian constitutionalism on the issue of dignity; the impact of contemporary cultural diversity on the secularization and universalization of human dignity. The scientific canons for discussion of the category "human dignity" are expanding through the application of the concepts of iterativeity, polymorphism, divergence, expressive theory of law in matters of interaction of human rights, democratic constitutionalism, national and international legal order, various forms of human activity, involving the use of the potential of human rights in their sectoral and socio-political specifics.

2 Можно ли считать, что конституционализм по сравнению с международным публичным правом и международной юриспруденцией прав человека, воспринимая базовые положения о достоинстве человека, значительно расширяет конституционные, правовые и судебные формы институционализации и обеспечения человеческого достоинства? В международном публичном праве, несмотря на значительное количество универсальных правовых актов, упоминающих человеческое достоинство, нет согласованной позиции о статусе таких положений (о достоинстве). Наиболее авторитетная позиция отечественных ученых – упоминание о человеческом достоинстве в контексте “работыˮ такого основного принципа международного публичного права, как уважение прав человека в связи с его развитием после Второй мировой войны [Карташкин 2019, с. 38–49]; или развитие идеи прав человека и ее критики в международной юриспруденции [Толстых 2019, с. 502]. Многие ученые-международники (российские и иностранные) констатируют отсутствие принципиального консенсуса в отношении правового института достоинства. На мой взгляд, принцип уважения, защиты и охраны человеческого достоинства имеет право на более высокий статус; он может претендовать на статус самостоятельного (и взаимосвязанного с другими) общего принципа международного права.
3 В международной юриспруденции прав человека человеческое достоинство рассматривается как ведущая идея (или принцип), которая помогает оправдывать “широкое толкование прав человекаˮ; “усиливает центральное значение и важность рассматриваемого права и ограничивает возможные исключения или ограничения из этого праваˮ (права на достоинство). Профессор международного права П.Дж. Карозза (Университет Нотр-Дам)1 утверждает, что трудность достижения консенсуса в отношении значения и последствий человеческого достоинства в международном праве прав человека может объясняться тем фактом, что в нем говорится как об основополагающей предпосылке прав человека, так и о принципе, который влияет на толкование и применение конкретных прав человека [Carozza 2013, p. 346–347]. 1. 4 Заслуживает внимания и обсуждения вопрос о возможности принятия Декларации ООН об уважении, защите и охране человеческого достоинства для современного мира. Такая декларация способна аккумулировать универсальные правовые нормы (в настоящее время они разбросаны по многим актам) и одновременно разграничить правовой режим и юридические формы человеческого достоинства как универсального права человека, лежащего в основе социобиологической природы человека и его пра́ва на права́.
5 Современный европейский и российский конституционализм имеют как различные правовые принципы и практики, так и общие векторы развития. Важное значение приобретает возможность российско-европейского диалога в позиционировании человеческого достоинства. В европейской правовой культуре человеческое достоинство рассматривается как “сердце европейского конституционализмаˮ, как принцип “европейского конституционализма первого порядкаˮ со значительным эвристическим потенциалом [Dupré 2016, p. 5; Dupré 2013, pp. 319–320]. Российский конституционализм потенциально содержит вектор правовой гуманитарной экзистенции, базирующийся на положениях ч.1 ст.21 Конституции РФ и правовых позициях Конституционного суда РФ. Количество положений Конституции РФ 1993 г. о достоинстве расширилось после внесения поправок Законом РФ о поправке к Конституции РФ от 14.03.2020 № N 1-ФКЗ), одобренных в ходе общероссийского голосования 01.07.2020 г. Теперь слова “достоинствоˮ и “достойныйˮ употреблено четыре раза в Конституции РФ (ч.1 ст.21 – “Достоинство личности охраняется государствомˮ; ч.2 ст.21 – “Никто не должен подвергаться пыткам, насилию, другому жестокому или унижающему человеческое достоинство обращению или наказаниюˮ; п. “ж.1ˮ ч.1 ст.72 Конституции РФ – “создание условий для достойного воспитания детей в семьеˮ; ст.75.1 – “В Российской Федерации… гарантируется защита достоинства граждан и уважение человека труда…ˮ). Два последних положения являются новыми. Принцип защиты достоинства граждан (ст.75.1 Конституции РФ) по формулировке у́же, чем признаваемый в правовых позициях Конституционного суда РФ, который распространяет охрану и защиту достоинства не только на граждан РФ, но и на других лиц (иностранных граждан, бипатридов, апатридов)2. Представляется важным конституционному правосудию и юридической практике оставаться в пределах широкой интерпретации нового конституционного положения. 2.
