Abstract

The article discusses the problems of identification of human dignity in constitutional and philosophical legal discourse, examines the sociobiological nature and essence of dignity in modern constitutionalism and international jurisprudence; the origin and use of "dignitas" in the Roman legal tradition; the development of ideas about human dignity in the Renaissance and their impact on legal doctrines and modern practice of constitutional justice. The work assesses the prospects for the elevation of human dignity in modern jurisprudence from the perspective of philosophical and meta-legal analysis. The article substantiates why the word "dignity" occupies a central position in the contemporary ethical and legal debate. The aim of the article is to define the meaning and role of legal polymorphism in creating various legal forms of human dignity; the role of dialogue between European and Russian constitutionalism on the issue of dignity; the impact of contemporary cultural diversity on the secularization and universalization of human dignity. The scientific canons for discussion of the category "human dignity" are expanding through the application of the concepts of iterativeity, polymorphism, divergence, expressive theory of law in matters of interaction of human rights, democratic constitutionalism, national and international legal order, various forms of human activity, involving the use of the potential of human rights in their sectoral and socio-political specifics.

3 Если задуматься над высказыванием А. Камю, взятое эпиграфом к данной статье, в форме вопроса “почему?ˮ, то ответ не заставит себя ждать, потому что именно человек обладает собственным достоинством. В современных исследованиях (философов и юристов) акцентируется внимание на двух ключевых факторах, связанных с человеческим достоинством, как оно понимается в текущих дебатах. С одной стороны, это фактор отсутствия согласия в концептуальном осмыслении достоинства и ясности, точности его определения; с другой стороны, фактор повышенной моральной, экзистенциональной и правовой ценности человеческого достоинства в различных дискуссиях о правах человека, конституционализме, биоэтике и трансгуманизме.
4 Для целей настоящего исследования под достоинством понимается неотъемлемое качество человеческой личности, которое выражает два взаимосвязанных элемента: 1) самоуважение и самоценность; 2) признание ценности человеческой личности и уважение к ней со стороны других. Человеческое достоинство рассматривается как понятие и концепция в контексте диалога философско-этических, антропологических, конституционно-правовых и международных дискуссий. Достоинство может по-разному интерпретироваться в различных идеологиях и концепциях публичной и индивидуальной этики (солидаризма, либертарианства, анархизма), которые требуют специального исследования; с позиций правовой экзистенции, международной публично-правовой этики и современного конституционализма человеческое достоинство представляет собой общечеловеческую ценность с культурной и географической спецификацией, так как им обладает каждый представитель человеческого рода, оно связано с автономией лица и самореализацией таким лицом своих способностей в условиях культурных, географических и правовых различий. Человек достойный (homo dignus) как характеристика современного человеческого существа – это результат воздействия гуманистических идей Возрождения, современных представлений о человеческой личности через призму прав человека, конституционализма и человеческого процветания. Значительный вклад Мирандолы (в интерпретацию достоинства человека) состоит в том, что он акцентировал свою позицию на понимании достоинства человека одновременно как божественного дара и результата самотворения и саморазвития человеческих качеств в обществе [Мирандола 1962, с. 506–514].
5 Саморазвитие способностей, этого божественного дара рассматривается в качестве продолжения божественного творения. В работе “Специалисты человеческого достоинстваˮ утверждается, что “человеческое достоинство было рационализировано и стало главной чертой современного политического ландшафтаˮ; в послевоенный период оно соединило старые и новые аргументы и институциональные механизмы для своего обеспечения; каким бы отличительным человеческое достоинство ни было в современную эпоху, оно “не является достижением чистого изобретенияˮ [Bennett 2016, p. 21]. Наиболее влиятельное положение человеческое достоинство получило по отношению к правам человека. Его стали рассматривать комплексно в терминах защиты и обеспечения прав человека, основных свобод личности, содействия социальному благополучию, взаимной терпимости и взаимного уважения [Quataert 2011, p. 4].
