Abstract

Currently, there is an increased focus on reducing the negative impact on the environment in the Russian Federation. In order to implement the Clean Air Federal Project, Federal Law No. 195-FZ dated July 26, 2019, established an experiment with quotas for emissions of pollutants into the atmosphere. Due to the current lack of liability for failures to achieve or untimely achievement of the established emission quotas, the Russian Ministry of Natural Resources has drafted a federal law establishing, among other things, administrative liability for failure to achieve pollutant quotas. However, the author believes that the punishment in the form of a “turnover-based” fine stipulated by the draft law has a number of shortcomings. The author believes that without updating the current laws, the application of the rule in question will not achieve the main objectives of the federal project. Moreover, it can lead to negative consequences not only for business, but also for the environment in general. In her study, the author examines the main issues of applying “turnover-based” fines for failure to achieve quotas using the example of fuel and energy companies and proposes ways to bridge the identified gaps.

1 Возникновение новых правовых отношений неизбежно влечет за собой изменения в сфере государственного принуждения, связанные с необходимостью создания эффективного взаимодействия, позволяющего контролировать реализацию субъектами правоотношений положений принятый правовых норм. Отдельные деяния, заключающиеся в несоблюдении обязательных положений закона, приобретают статус противоправных, и, как следствие, криминализуются законодателем. В доктрине отмечается, что процессы криминализации и декриминализации являются постоянными и выступают реакцией государства на ту или иную деятельность субъектов права [1].
2 В сфере публичных отношений, регулируемых, в том числе, и природоохранительным правом [2], среди основных методов обеспечения исполнения субъектами правоотношений своих обязанностей можно выделить государственный надзор и эффективную систему мер ответственности, в частности административной, за неисполнение установленных обязанностей или нарушение определенных нормами права запретов.
3 В настоящее время в Российской Федерации повышенное внимание уделяется вопросам снижения негативного воздействия на окружающую среду [3]. Федеральным законом от 26.07.2019 № 195-ФЗ «О проведении эксперимента по квотированию выбросов загрязняющих веществ и внесении изменений в отдельные законодательные акты Российской Федерации в части снижения загрязнения атмосферного воздуха» [4] (далее – Закон № 195-ФЗ) было закреплено проведение эксперимента по квотированию выбросов загрязняющих веществ (за исключением радиоактивных веществ) в атмосферный воздух на основе сводных расчетов загрязнения атмосферного воздуха (далее – эксперимент, эксперимент по квотированию) на установленных законом территориях.
4 Целью эксперимента является обеспечение снижения уровня загрязнения атмосферного воздуха в плановый период с 1 января 2020 года по 31 декабря 2026 года [5]. Деятельность по регулированию выбросов, направленная на достижение вышеуказанной цели, в соответствии с Законом № 195-ФЗ представляет собой утверждение комплексных планов мероприятий по снижению выбросов загрязняющих веществ в атмосферный воздух, а также установление квот выбросов приоритетных загрязняющих веществ по результатам проведения сводных расчетов.
5 В настоящее время уже возможно отметить положительные тенденции проводимого эксперимента, а полученные результаты в свою очередь соответствуют намеченным целям федерального проекта «Чистый воздух». В частности, данное утверждение в полной мере относится и к организациям ТЭК. Так, например, в период с 2018 года по текущую дату 2023 года в ходе реализации планов мероприятий АО «ТГК-11» по техническому перевооружению котлоагрегатов с заменой электрофильтров, а также модернизации градирен снижение совокупного объема выбросов приоритетных загрязняющих веществ составило 8,4 тыс. тонн, что представляет собой 46% от общего объема необходимого снижения в рамках эксперимента по квотированию.
