Abstract

The monograph Legal Support of the Implementation of Climate Projects in the Russian Federation and Abroad edited by LL.D., Professor V.V. Romanova has turned out to be relevant and well-timed. The monograph is interesting in terms of content and structure as it reflects the multi-level structure of the regulation of energy law. Notwithstanding the objective necessity to solve climate problems at the universal level, certain climate projects are implemented at the national level only. For Russia, national regulation tasks go hand in hand with the development of the legal regulation within the framework of the Eurasian Economic Union. The monograph reviews in detail special aspects of the legal regulation of reduction in greenhouse gas emissions in the Russian Federation and abroad. Attention is paid to the present-day state and results of the use of known climate project validation, verification systems. In the final part, the author sums up the performed study, substantiates its importance for the Russian fuel and energy complex and describes tasks for future work.

1 Проблемы изменения климата на земле приобрели программный характер не только в среде ученых представителей естественных наук, но они стали генератором политических процессов, проходящих в ведущих промышленно развитых государствах и их объединениях. Страх перед климатическими катаклизмами стимулирует принятие решений, как на национальном, так и международном уровне. Наиболее яркие примеры дает практика стран Евросоюза и ЕС в целом.
2 Вместе с тем, наряду с безоговорочной уверенностью одних ученых и политиков, что современная углеродная энергетика – это путь к климатической катастрофе, связанный со всеобщим потеплением, другие видят проблему также и в контексте естественного цикличного изменения климата на Земле. Не отрицая негативного использования углеводородного топлива на озоновый слой атмосферы, специалисты обращают внимание на аналогичные выбросы в атмосферу природного происхождения, а также на историю климата планеты, где потепления сменялись похолоданиями, вплоть до ледниковых периодов.
3 Не претендуя на обоснованность той или иной точки зрения, следует констатировать, что в сфере реальной политики вектор на развитие «зеленой энергетики» приобретает не только программный, но и императивный характер, индикатором чему служит правовое регулирование, принимаемое как на международном, так и национальном уровнях.
4 Особое внимание на углеродную энергетику, как на возможного виновника негативных изменений в климате, обращают в Евросоюзе, где получает поддержку развитие технологий альтернативной энергетики. С позиций экологической безопасности это можно понять и приветствовать, поскольку Европа является одним из основных потребителей углеродных энергоносителей и не является их экспортером.
5 Это обстоятельство позволяет структурам Евросоюза проявлять определенную агрессивность в правовой политики отказа от углеводородной энергетики, как средства давления на другие страны, экономика которых объективно ориентирована на развитие углеводородной отрасли. Для России стремительный и безальтернативный переход на «зеленый вариант» по европейской модели сопряжен не только с необходимостью форсированного развития новых технологий, но и решением экономических, социальных и правовых проблем, касающихся экономики страны в целом, отягощенных при том проблемами отдельных регионов.
6 Существующие неопределенности в оценках самой природы глобального потепления, а также различия экономик мирового сообщества служат причиной существенных различий в подходах к правовому обеспечению реализации климатических проектов.
7 Для России, как мировой энергетической державы указанные проблемы имеют особое значение, поскольку связаны с обеспечением не только ее энергетического суверенитета, но и военно-политического.
