Abstract

Head of the Department of Energy Law of the Kutafin Moscow State Law University (MSAL) Director of the Energy Law Center of the Saint-Petersburg State Economic University (SPbSEU) The nature of the legal regime of energy resources, requirements for their quality, metering, extraction, production, delivery, transportation, storage, pricing, customs regulation are fundamental problems of energy law. Certainty in the legal regulation of the use of energy resources as the key object of social relations within the scope of energy law has a direct impact on securing the balance of interests between energy law subjects at national and international levels. The level of the international unification of provisions on the legal regime of energy resources remains low, with the exception of unified provisions on the use of nuclear power. Due to the specific nature of energy resources, both national and international unification is performed primarily using an industry-based approach. Further development of the legal regulation of the use of energy resources, the improvement of the legal regime of energy resources, in particular, factoring in the need to apply innovative energy saving, energy efficient technologies, ensuring anti-terrorism security, and industrial safety of the energy infrastructure require legal studies in this area. Comparative legal studies of provisions on the legal regime of energy resources in other countries will be especially valuable. This article can be useful for further research into the subject matter, for education purposes.

Текущее состояние и задачи правового регулирования в области использования энергетических ресурсов
2 Содержание правового режима энергетических ресурсов, требования в отношении их качества, количества, учета, порядка добычи, производства, поставки, транспортировки, хранения относятся к фундаментальным проблемам энергетического права.
3 От надлежащего правового регулирования использования энергетических ресурсов зависит уровень состояния энергетического правопорядка [1].
4 Определенность в правовом регулировании использования энергетических ресурсов как ключевого объекта общественных отношений, входящих в предмет энергетического права, прямым образом влияет на обеспечение баланса интересов участников энергетических рынков на национальном и международном уровнях.
5 Принципы использования энергетических ресурсов должны обеспечивать баланс интересов различных участников энергетических рынков. К основным принципам использования энергетических ресурсов относятся: доступность энергетических ресурсов для потребителей; учет используемых энергетических ресурсов на всех стадиях, включая добычу, производство, поставку, транспортировку, передачу, хранение; адекватное ценообразование на энергетические ресурсы; применение энергосберегающих, энергоэффективных технологий; безопасность при использовании энергетических ресурсов; надлежащее состояние энергетической инфраструктуры, включая обеспечение требований промышленной безопасности и антитеррористической защищенности.
6 В силу специфики энергетических ресурсов унификация как на национальном, так и на международном уровне осуществляется в основном по отраслевому принципу.
7 Унифицированного нормативного правового акта, устанавливающего требования к правовым режимам энергетических ресурсов, на сегодняшний день нет. Особенности правового режима энергетических ресурсов, в зависимости от того, объектом каких отношений являются энергетические ресурсы, закреплены в различных нормативных правовых актах, регулирующих частноправовые или публично-правовые отношения, а также определяются в соответствии с условиями, согласованными сторонами соответствующих договоров.
8 Основными нормативными правовыми актами общего характера, регулирующими отношения в данной сфере, в том числе являются Конституция Российской Федерации, Гражданский кодекс Российской Федерации, Налоговый кодекс Российской Федерации, Кодекс Российской Федерации об административных правонарушениях, Закон Российской Федерации от 21 мая 1993 года № 5003-1 «О таможенном тарифе», Федеральный закон от 17 августа 1995 года № 147-ФЗ «О естественных монополиях», Федеральный закон от 26 июля 2006 года № 135-ФЗ «О защите конкуренции» и др.
9 Общие положения, устанавливающие требования к учету энергетических ресурсов, энергосбережению, энергоэффективности, установлены на уровне Федерального закона «Об энергосбережении и о повышении энергетической эффективности и о внесении изменений в отдельные законодательные акты Российской Федерации».
