Current Tasks Of Energy Law As A Science And An Academic Discipline

Quite a lot of problems are facing energy law today. First of all, these are fundamental problems: legal regulation of the balance of interests of energy resource suppliers and consumers, legal regulation of access the energy networks, legal regulation of pricing in the energy sector, legal protection of rights of energy market players. Legal regulation development trends at the national level are determined by tasks of energy security legal regulation in the Russian Federation. No less pressing are problems of international law regulation in the energy sector. This applies to both international private and international public law relations. Currently, there is a trend towards intensification of energy law studies. Areas of scientific research are conditioned primarily by the most pressing tasks, problems of legal regulation in the energy sector, existing gaps. Areas of law studies conducted by scientists within their thesis research include the following: specific features of the legal status of energy companies in different energy sectors, legal regulation of corporate governance in state-owned energy companies, challenges of legal regulation of natural gas exports, challenges of legal regulation of the use of renewable energy sources, legal regulation of procurements, challenges of legal regulation of energy companies’ access to foreign markets. The article also addresses education development objectives in the energy law sector for students at all levels. It seems appropriate to develop international cooperation on energy law in both scientific and educational processes, to create educational programs including foreign energy law courses, in particular, considering students’ areas of research, experience sharing, comparative law studies. Such cooperation will contribute to development of international law regulation in the energy sector necessary to implement international projects, as well as development of national regulation in practical activities of energy companies, authorized state bodies, in training of legal staff with field-specific expertise.

1	Существенный вклад в формирование и развитие науки энергетического права внесли такие ученые, как А.П. Вершинин, О.А. Городов, М.И. Клеандров, П.Г. Лахно, А.Г. Лисицын-Светланов, В.Ф. Попондопуло, В.В. Романова, Р.Н. Салиева, Л.И. Шевченко, В.Ф. Яковлев и др. [1]. В работах ученых исследовались вопросы о правовой природе отношений, регулируемых энергетическим правом, принципах, методах энергетического права, источниках энергетического права, рассматривались различные аспекты договорного регулирования, саморегулирования, международно-правового регулирования.
2	В настоящее время есть тенденция к активизации проводимых исследований по энергетическому праву. Направления научных исследований обусловлены прежде всего наиболее актуальными задачами, проблемами правового регулирования в сфере энергетики, имеющимися пробелами.
3	Представляется возможным обратить внимание на правовые исследования проблем правового регулирования энергетических рынков, защиты прав участников энергетических рынков, правового обеспечения энергетической безопасности [2].
4	Среди направлений правовых исследований, которыми занимаются специалисты в рамках диссертационных исследований, можно отметить в том числе следующие: исследуются особенности правового положения энергетических компаний в различных отраслях энергетики, правовое обеспечение корпоративного управления в компаниях с государственным участием в сфере энергетики, проблемы правового регулирования экспорта природного газа, проблемы правового обеспечения использования возобновляемых источников энергии, правового регулирования закупочной деятельности, проблемы правового обеспечения доступа энергетических компаний на зарубежные рынки [3].
5	Проблем, которые сегодня стоят перед энергетическим правом, достаточно. Прежде всего это касается фундаментальных проблем: правового обеспечения баланса интересов поставщиков и потребителей энергетических ресурсов, правового обеспечения доступа к энергетическим сетям, правового регулирования ценообразования в сфере энергетики, правового обеспечения защиты прав участников энергетических рынков. Тенденции развития нормативно-правового регулирования на национальном уровне обусловлены задачами правового обеспечения энергетической безопасности Российской Федерации.
6	В период неблагоприятной эпидемиологической обстановки многие проблемы правового регулирования в сфере энергетики стали еще более видимыми. Это касается правового обеспечения баланса интересов участников энергетических рынков, растущей задолженности перед компаниями, поставляющими энергетические ресурсы.
7	В целях поддержки потребителей энергетических ресурсов Постановлением Правительства Российской Федерации от 2 апреля 2020 г. № 424 «Об особенностях предоставления коммунальных услуг собственникам и пользователям помещений в многоквартирных домах и жилых домов» предусматривается мораторий до 1 января 2021 г. взыскания неустойки за просрочку платежей за коммунальные услуги [4].
