U.S. Sanctions Against China and Russia: Comparative Analysis

Abstract

The U.S. foreign policy relies on the use of economic sanctions in relations with both China (PRC) and Russia (RF). The National Security Strategy of the United States identifies PRC and RF as significant threats to the U.S. However, the view of China concentrates on long-term trends, while Russia is an immediate challenge, especially after the launch of its Special Military Operation in Ukraine on February 2022. This difference must have a reflection on the level of sanctions policy against these two targets. The substance of such differences in terms of sanctions instruments in use as well as the quality and quantity of their implementation is central for this article. Another question is about the ways the U.S. Congress and Administration approach China and Russia in terms of sanctions. Are they really on the same page or do they compete in their approaches to Beijing and Moscow? In terms of methodology, Russian International Affairs Council (RIAC) databases represent the major source for comparative analysis. Another source is the U.S. legal acts on sanctions against China and Russia and the practice of their implementation. The analysis reveals major differences in sanctions policy of the U.S. vis-à-vis the two adversaries. Washington implements much wider set of sanctions instruments against Russia in comparison with China. Major Russian companies and sectors of economy are the targets of different kinds of sanctions, while Chinese ones are targeted to a much less extent. The intensity of the use of sanctions is again much greater in the Russian case. Partisan differences in Congress on China are more salient than on Russia, however, disagreements are not critical in both cases. Further aggravation of Sino-American relations may mitigate the differences of sanctions against Russia and China in the future.

ВВЕДЕНИЕ
2 Стратегия национальной безопасности США определяет КНР и РФ в качестве ключевых угроз, причем со стороны Китая они имеют долгосрочный характер, а Россия представляет опасность здесь и сейчас [ист. 1]. Возникает ряд вопросов: в чем конкретно состоит ограничительная политика США в отношении КНР и РФ? Как именно она проявляется на уровне законодательной и исполнительной ветвей власти? В чем различия санкций США в отношении КНР и РФ?
3 Гипотеза состоит в том, что различаются масштабы применяемых санкций, а набор инструментов ограничительных мер совпадает в обоих случаях. Эти сходства и различия по-разному проявляют себя на уровне двух ветвей власти. Конгресс может предлагать сопоставимый уровень санкций как в отношении Китая, так и России с учетом значимости обеих стран в публичных дискуссиях. От Администрации следует ожидать большего внимания к России, чем к Китаю, так как исполнительная власть реагирует на конкретные политические проблемы, а уровень враждебности в отношениях с Россией в настоящий момент выше в связи с украинским кризисом.
4 Под санкциями будем понимать односторонние ограничительные меры, которые применяются страной-инициатором в отношении стран-мишеней, а также против отдельных лиц и организаций в этих странах и за их пределами. Целями санкций являются смена политического курса страны-мишени, нанесение ей экономического ущерба, посылка политических сигналов [1], а также влияние на бизнес, работающий в юрисдикции страны-мишени с ее гражданами и компаниями [2]. Среди инструментов – блокирующие и секторальные финансовые санкции, запреты на импорт и инвестиции, экспортный контроль, транспортные и визовые ограничения и др. Вторичные санкции предполагают применение блокирующих финансовых мер в отношении лиц из третьих стран за обход санкционного режима. От них следует отличать уголовное и административное преследование нарушителей режима санкций. Для этого требуется связь с юрисдикцией США, тогда как вторичные санкции такой связи не подразумевают.
5 Для оценки различий в подходах к санкциям против КНР и России на уровне законодательной власти использована база данных санкционных законопроектов Конгресса США, подготовленная в Российском совете по международным делам (РСМД). Оценка подходов Администрации проводится на основе базы данных санкционных событий РСМД, а также анализа нормативно-правовых документов и правоприменительной практики.
6 Политика санкций США в отношении КНР и России раскрывается в литературе [3, 4, 5, 6, 7]. Однако анализ редко проводится с учетом различий между политикой законодательной и исполнительной ветвей власти США, которые по вопросам внешней политики могут выступать не только партнерами, но и соперниками [8]. Целью статьи наряду с проверкой гипотезы является заполнение этого пробела.
