Analysis of the Current State of Affairs Around the BTWC: Problems and Their Possible Solutions

Abstract

The COVID-19 pandemic has highlighted the relevance of biosecurity and biosafety issues, including such risks as the deliberate use of biological weapons, agroterrorism, and developments in life sciences with dual-use potential. Throughout its almost 50-year history, the Biological and Toxin Weapons Convention (BTWC) regime has faced many challenges, a majority of which have demanded attention ever since. For example, the problem of universality remains topical. The verification mechanism has not received enough development since 2001. Also, the BTWC regime has to face the inequality of economic, scientific and technological development of the States parties that, altogether with the inequalities in the BTWC implementation experience, makes the regime vulnerable. Amid these long-standing and profound issues new threats continue to emerge, like the erosion of global arms control and disarmament architecture as well as developments in science and technology. Even though States parties to the BTWC agree on the need to establish effective mechanisms for reviewing scientific and technological developments, there is no unanimity in approach or possible format. Moreover, agroterrorism, despite its increased relevance, is not covered properly within the BTWC regime. The list of challenges is extensive, however, there is a larger list of possible measures designed to strengthen this regime. Given that the sustainability of any regime is based on the political will of its members to comply, it is essential to enhance states’ commitments and stimulate their interest through a variety of proposed measures. Joint activities, like the renewal of confidence building measures, addressing risks of bioterrorism, or reviewing scientific and technological developments related to the Convention, in particular, may give the impetus needed.

О ВОЗМОЖНЫХ ПУТЯХ УКРЕПЛЕНИЯ РЕЖИМА КБТО
1 Биологическая безопасность является одной из принципиальных составляющих общей системы безопасности, обеспечивающей стабильное развитие как отдельных государств и регионов, так и всего мирового сообщества. В последние годы широко обсуждаются опасения, связанные с тем, что некоторые биотехнологии, имеющие потенциал двойного применения, могут стать одним из самых доступных инструментов поддержания нестабильности и создания атмосферы страха, хаоса и социальной напряженности. Об угрозах, связанных с поражением населения такими особо опасными патогенами, как сибирская язва, лихорадка Эбола, чума, сибирская язва и др., и анализе состояния проблемы в целом в последнее время написано довольно много [1]. Здесь следует упомянуть, что раньше масштабные пандемии уже случались, и один из наиболее ярких примеров – пандемия, вызванная вирусом “испанки”, которая возникла в начале ХХ в. и унесла жизни десятков миллионов жителей Земли [2]. В начале ХХI в. в Азии (2003 г., вирус SARS) и в Саудовской Аравии (2012 г., вирус MERS) имели место эпидемии так называемой атипичной пневмонии, но по степени распространенности и числу летальных исходов они были несравнимы с COVID-19, распространение и последствия которого весьма велики и пока трудно поддаются глобальной и объективной оценке [3]. Важно и то, что появляются новые современные направления исследований, ведущиеся сегодня в лабораториях многих стран, – например, синтетическая биология и генная инженерия, потенциальные проблемы которых, с точки зрения биобезопасности, были подробно обсуждены ранее [4]. Очевидно, что необходим постоянный мониторинг и анализ проблем биобезопасности, касающихся здоровья и благополучия населения, заблаговременная разработка решений для минимизации потенциальных последствий воздействия уже известных опасных патогенов не только на здоровье человека, но и на экологию, сельскохозяйственную и продовольственную сферы. Следует учитывать, что достижения новых направлений биотехнологий могут быть использованы в том числе и в противоправных целях. Здесь следует обратить особое внимание на то, что ситуация, возникшая с началом коронавирусной эпидемии, резко обострила полемику, связанную с недопущением использования биологического оружия (БО) и биотерроризма. Эта проблема все активнее и шире обсуждается не только учеными и политиками [5, 6, 7], но и общественностью [8, 9, 10, 11], поскольку хрупкость мировой безопасности во всех ее проявлениях стала как никогда очевидна и реальна. Пандемия, вызванная распространением коронавируса COVID-19, затронула все мировое сообщество. Всемирная организация здравоохранения (ВОЗ) 30 января 2020 г. объявила пандемию коронавируса nCoV-2019 чрезвычайной ситуацией международного значения, признав тем самым глобальный характер угрозы [12]. За неделю до этого Международный валютный фонд оценил негативное влияние начавшегося масштабного распространения эпидемии на всю мировую экономику и спрогнозировал рецессию “по меньшей мере такую же глубокую, как во время глобального финансового кризиса, или хуже” [13]. За последний год о проблемах, последствиях и опасностях, напрямую связанных с вызванной COVID-19 пандемией, сказано очень много [14, 15, 16]. При этом подводить окончательные итоги возникшей катастрофы, а также связанных с ней проблем и последствий преждевременно. Поэтому основное внимание в настоящей работе уделено обзору текущего состояния Конвенции о запрещении разработки, производства и накопления запасов бактериологического (биологического) и токсинного оружия и об их уничтожении (КБТО), а также задачам ее укрепления, в том числе в части совершенствования международных механизмов прогнозирования и снижения биологических рисков, связанных с научно-технологическим прогрессом.
