Abstract

The paper examines the phenomenon of global migration governance in its theoretical, institutional and political aspects. The author claims that the formula ‘global governance’ with regard to migration has sense only if it is applied to a set of administrative practices in various regimes of international mobility. This is the so-called “multi-level governance”, in which the managerial institutions of the subnational, national, macroregional and supranational levels coexist. As for the global migration governance in terms of the institutionalized process of supranational management of international migration, it is rather wishful thinking, represented by international bureaucracy, on the one hand, and civil society activists, on the other. As long as nation states remain the main actors in world politics, the appeal to supranational migration management will remain in the sphere of rhetoric. The contradictions between the interests of the states are too serious for them to pass on the transfer of competences in managing the sphere of migration to a supranational level.

1 В сентябре 2017 г. в штаб-квартире ООН в Нью-Йорке прошел саммит по проблемам миграции и беженцев. Одним из его итогов стало решение о необходимости разработки Глобального договора о миграции (Global Compact for Safe, Orderly and Regular Migration). Процесс согласования его отдельных положений занял более полугода. Рабочий вариант Глобального договора о миграции (далее Договор) был подготовлен в июле 2018 г., а итоговый вариант принят 10–11 декабря 2018 г. на Межправительственной конференции в марокканском Марракеше.
2 Хотя в самом тексте Договора [1] указано, что он не является юридически обязывающим, сама идея о возможности его заключения вызвала ожесточенные споры. Вскоре после завершения нью-йоркского саммита о выходе из Договора объявили США. Некоторые страны отказались подписывать его итоговый вариант. Многие европейские политики правопопулистской ориентации выразили протест против присоединения своих стран к Договору, считая это очередным шагом на пути “глобального правления”, подменяющего национальные правительства. Противники Договора остались в меньшинстве (его сторонниками стали 164 государства), но продолжающиеся жаркие дебаты вокруг него заставляют задуматься над тем, что же такое глобальное управление миграцией, действительно ли институты наднационального управления в этой сфере уже сформировались или по меньшей мере находятся в завершающей стадии своего формирования.

“ГЛОБАЛЬНОЕ УПРАВЛЕНИЕ” КАК КОНЦЕПТ

4 Понятие “глобальное (у)правление” (global governance) появилось в языке международной бюрократии и в академических дискуссиях в последнее десятилетие XX в. на фоне роста осознания того, что многие проблемы, с которыми столкнулось человечество, не могут быть решены на уровне отдельных государств. В 1992 г. при поддержке тогдашнего генсека ООН Б. Бутрос-Гали была создана Комиссия по глобальному управлению Commission on Global Governance. В 1995 г. она опубликовала доклад “Наше глобальное соседство” (Our Global Neighborhood) [2], в котором проводилась мысль о том, что национальные интересы в широком понимании слова предполагают международное сотрудничество, а не исключают его. Речь шла о необходимости расширения кооперации в таких сферах, как защита окружающей среды, борьба с организованной преступностью, торговля, финансы и вооруженные конфликты.
5 Так началась смена акцента с государствоцентричности на глобальность. Трудно сказать, кто внес в этот процесс более заметный вклад: академические ученые или профессиональные политики и дипломаты. Симптоматично, что составителем и редактором первой коллективной монографии о глобальном подходе к миграционной проблематике “Управление миграцией: время создавать новый международный режим” был консультант Международной организации по миграции (МОМ) Бималь Гош [3].
6 В 1980–1990-е годы в исследовании глобальных проблем (от безопасности до финансов) широко использовалось понятие “международный режим” (international regime), под которым понимались “нормы, правила, принципы и процедуры принятия решений, определяющие поведение государств в той или иной сфере” [4]. Позднее ему на смену пришло более широкое понятие “глобальное управление (правление)”, подразумевавшее выход за рамки собственно государственных интересов и межгосударственных отношений. Речь идет, среди прочего, об изменении роли международного права в мировой политике, совершенствовании механизмов выработки согласия, рационализации институтов [5, 6, 7].
