Future property donation agreement as a concluded in future inheritance contract law categories and norms qualification issues

Civil Law of the Republic of Latvia (hereinafter – Civil Law) section 1926 provisions in terms and essential norms, which prescribe future property transfer indicate that future property donation agreement contains a contractual inheritance clause.

Simultaneously, Supreme Court of the Republic of Latvia Senate in case number SKC - 642 dated December 1, 2004 establishes that provisions which clarifying deals’ participants will must contain clearly established rules, which contained as an imperative by Civil Law section 1507 provisions.

Interpreting this statement by norms, prescribed by Civil Law section 1926 provisions in accordance with statements, fixed in Civil Law section 1507 provisions in accordance with the requirements for interpretation, which is preferred is the interpretation according to which the transaction is supported and, if possible, remains in force in regard to deals, prescribed by Civil Law sections 639 and 1926.

In the absence of proper qualification Civil Law sections 639 and 1926 provisions will be unreasonably mixed.

Undoubtedly, the legal force of the transaction in accordance with Civil Law section 1926 norms in regard to Civil Law section 639 norms, expressed in future property legal category, should provide an additional argument for contractual inheritance clause presence and consolidation in aim to future property donation agreement legal category qualification according to inheritance contract imperative rules. 

In turn, the contractual inheritance clause must determine the rules that denote the composition of subjects, the composition of objects, as well as the content of future property donation agreement as an agreement that can be recognized on the essential grounds of the subject, object and substantive composition according with inheritance contract rules.

It is the circumstances set out in the last paragraph that give rise to the need to analyze the grounds for qualifying the rules of law of future property donation agreement as a rules of law of an inheritance contract.
