Abstract

The criminal procedure doctrine has developed a classification of the forms of bringing to trial, while their distinctive features are highlighted, by which they can be identified. In general, judicial-revision, accusatory and mixed forms of trial are distinguished.

While the institution of bringing to trial in the criminal procedure of a particular state can be generally attributed to a certain form, it is, however, incorporates the peculiarities of the national procedure of criminal proceedings in its legislative reflection. The urgency of solving the problems of the institution of bringing the accused to trial in criminal proceedings of Russia, which has not changed substantially since the adoption of the Code of Criminal Procedure of the Russian Federation, forces us to turn to a comparative legal study of the legal regulation of this institution. On the one hand, it is legitimate to consider the experience of Western countries, since the criminal process of Russia is historically interconnected with the European legal traditions. In addition, the approaches of Western countries "mutatis mutandis" are widespread in the world.

Nevertheless, the example of the countries of the Far East[1] confirms that even despite the borrowing of Western models of criminal proceedings or individual Western institutions, their laws define the specifics of the procedure for criminal proceedings, reflecting national legal traditions and having a certain identity, especially when regulating the procedure for bringing the accused to court.

This article analyzes the institution of bringing o trial in the criminal process of some countries of the Far East, studies its features and highlights the elements of judicial-revision and accusatory forms of bringing to trial, classifies the countries of the Far East on this basis.
