Abstract

At the beginning of the article, the author considers such a feature of law as consistency, which is characteristic not only for jurisprudence, but also for other sciences and offers his vision of the problem. An overview of three well-known discussions on the concept and structure of the legal system was made.Based on the provisions of the general theory of law and the theory of systems, the author proposes his own formulation of the legal system. Based on the analysis of scientific works and the norms of Russian law, new basic and additional criteria for the allocation of branches of law have been identified. Taking part in the discussion on the preservation of branches of law in the Russian legal system, the author concluded that in modern conditions of digitalization and transformation of public administration in Russia, it will no longer be possible to absolutely stay in the sectoral division of the legal system, since the systematization of normative legal acts, as well as the preparation of strategic planning acts, is carried out according to criteria such as the field of activity, authorities, types of legal acts. Meanwhile, the sectoral division of law is an almost ideal model for teaching students, since most textbooks and work curricula are written on the basis of the sectoral principle.

This article on the pages of the Journal of Russian Law proposes to renew the discussion about the legal system, its elemental composition, determinants influencing its development, and models of interactions with other systems of regulatory regulation.
