Abstract

The authors focus on the problems of public power. In this regard, the following issues are comprehensively investigated: the concepts and nature of territorial public-legal communities and public-legal entities, social and legal sources of public-legal power. The authors conduct a comprehensive detailed analysis of the constitutional norms and legislation of the subjects of the Russian Federation. The conclusions are based on the extensive use of the comparative legal method, which shows the specifics of the development and legislative regulation of the named institutions in Russia and abroad. A new approach to the study of 1) models of public-legal power in their correlation with the state power and 2) the definition of public power of the state and its territorial public-legal communities-entities is proposed. The conclusion about the need to create a modern constitutional concept of the unity of public power, taking into account the differences of its types and the special sovereign power of the state is substantiated.
