Constitutions as a legal model of social convergent technology (on the 30th anniversary of the Constitution of Russia)

Abstract

This article is dedicated to the 30th anniversary of the Constitution of Russia. The author, who took part in the Constitutional Meeting and was a member of its Commission for finalizing the draft of the current Constitution, focuses the reader’s attention on the history of the development of the draft, as well as on its natural and positive legal foundations of the Constitution and the main issue of modern constitutionalism - the interaction of collective and individual in the organization of society and social solidarity. According to the author, the Constitution in its very essence is based on the natural law undergoing serious changes. Equally, the basis of the Constitution is philosophical positivism. The synthesis of natural law forms the normative unity of the Constitution. Such unity does not oppose the various social strata of society, but creates a space for cooperation and solidarity of society.
