Abstract

Referring to the research on the history of the emergence of notaries in Russia, a single ontological essence of the court and notaries is shown. Currently, the jurisdiction of the courts (both arbitration and general jurisdiction) is a number of so-called “indisputable” cases. These are cases of special and order proceedings. A significant part of them are cases on the establishment of legal facts, the consideration and resolution of which is carried out by the court outside the framework of the civilistic procedural form, but solely on the basis of the documents submitted by the applicant substantiating the stated requirements. Many scientists have already expressed the idea to transfer these cases from the jurisdiction of the courts to the notaries. However, it should be borne in mind that the notary is a body of indisputable jurisdiction, and notaries are not entitled to consider disputes about the law. At the same time, some cases of special and writ proceedings are of a controversial nature - for example, cases of depriving or restricting the legal capacity of a citizen; on involuntary psychiatric examination, on the recovery of alimony, etc. Therefore, it is necessary to distinguish between cases of special and writ proceedings into controversial and indisputable; notaries are invited to submit all cases of establishing legal facts. It is also proposed to expand the competence of the notary by including cases on amendments to the documents of a citizen. It is proposed to establish mandatory notarization of all out-of-court conciliation agreements.
