Abstract

In the criminal proceedings of the Russian Federation the problem of improving the procedure for changing the charges brought by the preliminary investigation body in the direction of worsening of the defendant’s situation is relevant. The authors of this article, in order to find the optimal legal model for changing the criminal charge in court by increasing or significantly amending it while ensuring the right of the accused to defense and the fairness of the trial, using such methods of scientific knowledge as dialectical, formal legal, statistical and comparative legal analysis reveal shortcomings of existing Russian procedures, conduct comparative study of models of legal regulation of the issues of changing charges in court and their practical application in some European and Asian countries, analyze these models from the point of view of ensuring the right of the accused to defense and taking into account the positions of the European Court of Human Rights. According to the results of the conducted research the conclusions are made about the possibility and expediency of modernizing the model used in the Russian Federation for changing the charge submitted to the court to a more serious or significantly different in factual circumstances by replacing the existing procedural order with meeting the requirements of the rights of the accused procedure for changing the original charge by the prosecutor under the supervision of the court directly at the court session
