Abstract

The article analyzes the prospects for the development of a procedural mechanism for bringing forward a criminal claim against a person, subject to resolution on the merits in the course of the trial.

By revealing the true historical reasons contributing to the rooting of the current procedure for bringing in as an accused in the Russian criminal process, the unreliability of the arguments expressed by scientists in support of the abolition or significant reform of this procedure, following the example of Germany and a number of other European states, has been proved. The conclusion is formulated about the possibility of a final resolution of the issues raised in the article, not otherwise than in the context of understanding the general concept of further improvement of the entire system of Russian pre-trial proceedings.
