Abstract

The article considers the legal basis and analyses the practice of using amicus curiae at two universal judicial bodies for peaceful settlement of international disputes - the UN International Court of Justice and the International Tribunal for the Law of the Sea. It notes that in these courts the amicus curiae mechanism is not as widely demanded as in other judicial and quasi-judicial international bodies such as regional courts of human rights, international criminal tribunals, investment arbitrations. This state of affairs may be attributed to a number of factors: the greater commitment of States to procedural predictability in inter-State litigation; the imbalance in capacity between States and individuals and entities in preparing arguments in support of their position, which amicus curiae may help adjust; and the specific evolution of human rights law in comparison with other branches of international law
