Abstract

The article substantiates the significance of the scientific study of the issues of the transforming influence of information and communication technologies on criminal punishment. Based on the analysis of objective data, a probabilistic prediction of the evolution of this criminal law institution in the digital reality is formulated. It is stated that the introduction of modern information and communication technologies with elements of artificial intelligence to monitor the execution of the types of punishment used will contribute to the objectivity of supervision of prisoners, reduce corruption risks, save budget funds, and prevent the de-socialization of convicts. It is substantiated that in the conditions of intensive digitalization of life and, as a result, crime, the domestic punishment system must be supplemented with a special punishment, which consists in restricting the right of a convicted person to a digital presence on the Internet. The paper draws a conclusion (forecast) about the possible introduction of a digital public safety rating in the Russian Federation and the addition of a new type of punishment to criminal law – a reduction in the public reliability rating.
