Abstract

The article raises a particularly important problem of the absence at the level of the General theory of law of the doctrine of merit, serving as the basis for the application of encouragement. As a result, branch Sciences are forced to be guided by their own diverse ideas about the deserved behavior of subjects of Russian law and the application of various measures of encouragement to the latter. In such circumstances, there are difficulties and mistakes in understanding and using the most effective legal incentive and method of regulation – encouragement. It seems essential to form a General legal theory of meritorious behavior as a legal basis for the application of incentives, which will serve as a Foundation for the sectoral Sciences. The General provisions of the theory of merit in law are formulated.
