Abstract

The institute of evidence in the criminal procedure arose long ago, developed inconsistently and was not provided with any scientific basis for a long time – all the evidence was either purely domestic or substantiated by the results of the ordeal. Nowadays this institution is legally regulated, classified in detail, and is based on solid, multi-branch scientific research. However, mainly, including relative proof – conclusion of forensic examinations, polygraph test (polygraph detector), usage of "truth serums", etc. Society, on the other hand, desperately needs criminal justice to be based on absolute proof. There are already scientific methodologies and technologies for such evidence – this is dactyloscopy (it is more than one hundred years old) and DNA analysis (it is about twenty years old, nowadays this method is more expensive and it takes a long time to make it). According to the author, the third in this row will become a mentoscopy method based on the fact that all the information received by a person through his senses is in his memory, and extracting it (what a person has previously seen and heard – accurate to second) is the task of the nearest future science, the fourth in the row of the type of absolute proof, according to the author, will be the method of "removing" the information of the state of human empathy; the fifth will be the reception of the information from person’s ancestors through his genomic nature…
