The population of the municipality and the local community: the ratio and use of concepts (legal aspects)

Abstract

The article investigates the problem of determining the key subject of municipal and local government. Current legislation does not disclose the term "local population". Moreover, the constitutional Court of the Russian Federation and a number of researchers pay special attention to local communities.

In this regard, the author analyzes the context of the use of these terms in the Federal legislation and practice of the constitutional Court of the Russian Federation, as well as various approaches to their definition in the legal literature. An attempt is made to identify and analyze some features of the main subject of the local level of public power. The unclear legal essence of this phenomenon does not contribute to the proper self-identification of citizens as participants in the municipal process. The approaches in the legal literature to the interpretation of the local community and the population of the municipality are analyzed.

With the help of formal legal method and analysis of the legal framework and modern achievements of the legal doctrine, it is concluded that the need for legislative disclosure of the concepts of the population of the municipality and the local community. At the same time, the population should be defined as a subject of municipal power, the content of which also requires a legislative definition, while municipal communities are more diverse and participate in various forms of voluntary territorial self-government.
