Abstract

. The article is devoted to the problems of interrelation of legal understanding, lawmaking and law enforcement on the example of Advocate’s Code of professional ethics. The author's understanding of law is presented. The author reveals the legal nature of morally ethical relations as a sigh of attributively inherent characteristic of advocate activity and particularly of its form – defense in criminal proceedings. The essential characteristics of the notion “rule of an advocate law” is defined. The author's point of view about the Advocate's Code of professional ethics as a legal act and the set of rules forming it as an institute of law is shown. On the example of paragraph 4 of article 6 and paragraph 2 of article16 of the Advocate's Code of professional ethics the author shows the dependence of the nature of it’s application from the type of legal understanding. The main approaches for the improvement of the Advocate's Code of professional ethics are proposed.
