United States-Mexico-Canada Agreement at the Finish Line

Abstract

Donald Trump’s promise to revise the NAFTA agreement was one of the main points of his pre-election platform and Trumponomics. This aim was reached in three years of his presidency marked by tough negotiations with Canada and Mexico as well as with the Democratic majority in the House of Representatives formed after the 2018 midterm elections. It took more than a year to convince Canada and Mexico to make concessions. Almost the same period was needed to find a compromise with the Democratic authorities in the Congress and sign the Protocol of amendments to the United States-Mexico-Canada Agreement (USMCA). Even after the approval of the implementing legislation by Mexico (June 2019, January 2020), USA (January 2020) and Canada (March 2020), however, USMCA didn’t take effect. To do it, it is needed to exchange the readiness notifications, and wait for 60 days more. The earliest forecast time of coming the USMCA into effect is June 1, 2020. However, it may be protracted in case one of the participating states is not ready. The article analyzes three issues: negotiations between the Office of the United States Trade representative and the Democratic authorities in the Congress; contents of the Protocol of amendments and the final USMCA text; and reaction to that event in the USA and Canada.

Ещё не вступив в силу, соглашение ЮСМКА подверглось основательной правке. Первый вариант, известный как ЮСМКА 1.0, после трудных переговоров продолжительностью 13 месяцев был подписан 30 ноября 2018 г. в Буэнос-Айресе представителями трёх участвующих стран. Его успела ратифицировать Мексика в июне 2019 г. Канада тогда заявила, что не будет торопиться, а будет осуществлять ратификацию с оглядкой на Соединённые Штаты. В США же процесс ратификации забуксовал после того, как Республиканская партия по результатам промежуточных выборов в ноябре 2018 г. утратила большинство мест в Палате представителей американского Конгресса.

Получившие контроль над нижней палатой демократы, не отвергая популярное соглашение с порога, заявили, что в его тексте много изъянов и недочётов, которые необходимо устранить. После выполнения всех формальностей, скрупулезно прописанных для «ускоренной процедуры» (fast-track authority) ратификации в американском законе 2015 г. «О торговых приоритетах и подотчётности», администрация Д. Трампа уже в конце июня 2019 г. могла направить в Палату представителей имплементирующее ЮСМКА законодательство [1]. Однако сделать это она не решилась из-за противодействия влиятельного спикера нижней палаты Н. Пелоси. Риск ослушаться был слишком велик: без поддержки со стороны руководства Демократической партии законопроект мог либо недобрать необходимого количества голосов и провалиться, либо надолго, если не навсегда, зависнуть в Палате представителей, так и не дойдя до стадии голосования. После долгих препирательств с республиканской администрацией и при публично выраженном согласии Д. Трампа Н. Пелоси летом 2019 г. сформировала комиссию из девяти демократов-конгрессменов во главе с председателем профильного бюджетного комитета Р. Нилом. Комиссия в сжатые сроки провела переговоры с главой Управления представителя США на торговых переговорах Р. Лайтхайзером. В результате совместных усилий был подготовлен Протокол об изменениях в ЮСМКА. Важно, что пролоббированные демократами поправки, ставшие частью окончательного варианта ЮСМКА, поддержало большинство американских отраслевых профсоюзов во главе с крупнейшим объединением АФТ‒КПП*. Это случилось впервые с 2001 г., когда АФТ‒КПП одобрило фритредерское соглашение между США и Иорданией.

 * Среди профсоюзов, критически настроенных к ЮСМКА, следующие: Объединенный союз работников автомобилестроения, Международная ассоциация машинистов и работников аэрокосмической отрасли, Объединенный союз рабочих пищевой промышленности и розничной торговли.
3 Протокол об изменениях был согласован с Канадой и Мексикой и подписан представителями трёх стран в Мехико 10 декабря 2019 г. Выступая на этой церемонии обычно сдержанный и не склонный к сантиментам Р. Лайтхайзер заявил, что заинтересованным сторонам – Белому дому, демократам-конгрессменам, лидерам американских профсоюзов, Мексике и Канаде – было непросто прийти к устраивающему всех решению. «Это просто чудо, что нам удалось договориться», ‒ сказал он [Цит. по: 2].
