Abstract

The article poses the issue of the practice of implementation of democratic reforms, their results and limitations as a part of the EU partnership with the South Caucasus countries. Author underlines that consolidation of democracy has been mentioned as the key goal of the EU- Armenia, EU-Georgia and EU-Azerbaijan cooperation. The subject of research are official agreements between the EU and the South Caucasian states, as well as the EU Commission documents that relate to the development of third countries. The author concludes that the focus of cooperation in democratic reforms has moved from regime transformation to adaptation of European administrative practices, building dialogue with civil society organisations. Despite certain success in selected aspects of the partnership, this has not brought any profound political change.

1 Становление демократии – цель выстраивания отношений ЕС с Азербайджаном, Арменией и Грузией, закрепленная в договоренностях с 1996 г. Именно тогда южнокавказские государства подписали идентичные Соглашения о партнерстве и сотрудничестве, в отдельной главе которых шла речь о сотрудничестве в сфере демократии и прав человека1. Авторы соглашения подчеркивали в качестве приоритетов верховенство закона, уважение прав человека, прав представителей меньшинств, установление многопартийной системы со свободными и демократическими выборами2. 1. 2 В дальнейшем стороны уделяли внимание развитию демократии в подпунктах разделов о реформах государственных институтов. В ст. 4 Соглашения о всеобъемлющем и расширенном сотрудничестве ЕС с Арменией указана цель развития, укрепления стабильности и эффективности демократических институтов и верховенства закона в качестве одного из направлений внутренних реформ3. В соглашении нет отдельного раздела, в котором бы уточнялось понятие «демократии» либо механизм, посредством которого демократические институты должны развиваться. 3. 3 Наряду с первостепенной важностью демократии, в преамбуле Соглашения об ассоциации Грузии с ЕС множество разделов и статей о секторальном сотрудничестве, реформах в отдельных сферах прописаны гораздо подробнее. В документе подчеркнуто, что ЕС основан на ценностях демократии, уважении прав человека и фундаментальных свобод, что служит фундаментом политической ассоциации и экономической интеграции. В ст. 4 соглашения подтверждено намерение сторон сотрудничать в развитии и усилении стабильности и эффективности демократических институтов и верховенства закона, в реформировании сферы правосудия и законодательства, государственного управления, борьбе с коррупцией4. Демократическое развитие авторы соглашения также упоминают в ст. 8 в контексте региональной стабильности и мирного разрешения конфликтов. 4. 4 Продвижение в сфере демократии – один из основных критериев, который Европейский союз использует, принимая решения о выделении средств на развитие сотрудничества с третьими странами. Среди главных показателей приверженности страны демократическому развитию – заявления политических лидеров о выборе пути сотрудничества с ЕС как основного, а также подписание соответствующих соглашений. Что именно подразумевается под демократическими реформами? Каким образом осуществлялось данное направление партнерства со странами Южного Кавказа? Каков достигнутый результат и его ограничения? В статье предпринята попытка найти ответы на эти вопросы.
5 Определение демократии применимо к политическим режимам, закрепленным в разных странах. В академических публикациях, к примеру, различают российскую модель суверенной демократии, либерально-демократическую модель США, социально-либеральную модель ЕС [Oskanian, Averre 2016]. Выход Великобритании из ЕС способствовал разделению британской демократической модели и демократии континентальной Европы [Буторина 2020]. Говорить о единой европейской демократической политической модели затруднительно из-за существования целого спектра понятий демократии.
