Legal Support of Rational Use of Energy Resources

The applicable laws place the highest value on the rational use of energy resources in the sphere of energy saving and energy efficiency in the Russian economic development. However, there remains legal uncertainty in terms of direct levers of the promising and rational use of energy resources. The legislator maintains “qualified silence” in this matter, the judicial practice is contradictory and ambiguous in the issues of acknowledgment of irrational behavior of energy market participants, there is no standard of proof. Along with these stagnation processes in legal support of the rational use of energy resources, the legislator piles up new constituent elements of administrative offenses and criminally punishable acts in the energy security sphere. Such instruments fail to deliver the desired results in form of the establishment of the rational use of non-renewable energy resources. Renewable energy resources in the context of legal support of the rational use are out of the question as there is no respective framework law. That’s why the author concludes that it is needed to establish a legal model of the rational and safe use of energy resources (legal compliance).

1	I Уровень проблематики
2	Современный уровень озабоченности состоянием энергетической безопасности в мире и России неуклонно растет, что отражается в стратегических программах развития экономики и ежегодных посланиях государственным органам власти высшим руководством страны. В послании Президента Российской Федерации к Федеральному Собранию в 2022 [1] году была озвучена необходимость жесткого контроля и мониторинга углеродных выбросов, снижение эмиссии парниковых газов с учетом климатических и географических особенностей нашей страны и ее научно-технологического потенциала. Также В.В. Путин призвал к необходимости разработки новых комплексных подходов в сфере развития перспективных направлений возобновляемой энергетики. Экологическая повестка продиктована реальными угрозами природной среде и доказанной дестабилизацией хозяйственной деятельности человечества. При этом субъекты внутреннего рынка не особенно заинтересованы в энергоэффективности и неохотно привлекают инвестиции в сферу использования передовых «зеленых» технологий. Отечественные инструменты в виде роста цен на ресурсы и ужесточения ответственности не дают желаемых результатов в виде формирования рационального использования невозобновляемых энергетических ресурсов.
3	Ближайшей повесткой рассмотрения законопроектов охватываются вопросы внесения изменений в части совершенствования действующих систем ликвидации накопленного вреда окружающей среде, внесение изменений в действующее административное и уголовное законодательство в части ужесточения ответственности за нарушения субъектов в рассматриваемой отрасли, в части создания систем контроля и мониторинга нарушений в отрасли, а также в части информационного обеспечения [2]. Что само по себе немало, но, при этом сохраняется правовая неопределенность в области прямых рычагов перспективного и рационального использования энергоресурсов, развивается стагнационный сценарий управления накопленными противоречиями, предсказанный учеными Российской Академии Естествознания [3].
4	Подобное развитие событий в соответствии с естественными законами и взятым правительством курсом экономического развития рано или поздно достигнет новой качественной фазы развития социума, экономики и энергетики. Однако, преступное вмешательство отдельных групп в системы безопасного и конкурентноспособного рынка энергетики, террористические угрозы, а также негативные политико-экономические амбиции недружественных стран в очередной раз ставят задачу перед правовым сообществом России о пересмотре действующей системы норм, не способной в должной мере обеспечить рациональное и безопасное использование энергоресурсов не только сейчас, но и в обозримом будущем. Поэтому именно сейчас необходимо законодательное форсирование в сфере энергетической безопасности как базиса рационального использования и накопления энергоресурсов.
