Offset of Emission Permits among Legal Entities Taking Part in the Permit Allocation Experiment (on the Example of Companies of the Fuel and Energy Complex)

Abstract

Issues of protection of the atmospheric air are among the priority ones for the state. However, operations of companies in certain production sectors, which inter alia include the fuel and energy complex (FEC), are directly associated with the emission of pollutants into the atmosphere. A permit allocation experiment has been approved within the framework of the Clean Air federal project but the experiment performance procedure has a number of gaps making it impossible to efficiently reduce the pollutant emission volume. The author has studied the main problems on the example of the FEC, in particular, heat supply and generating companies. The impossibility of permit-regulated companies to dispose of permits including by way of redistribution may lead to serious consequences for both the environmental and energy security of the country. The solution proposed by the author is introduction in the applicable laws of the mechanism of redistribution (offset) of pollutant emission permits, which will allow to drastically reduce the atmospheric air pollution level in large industrial centers.

1 Конституция Российской Федерации закрепляет право каждого на благоприятную окружающую среду [1], ведь качество жизни населения во многом зависит от таких факторов, как экологическая обстановка, в частности, качество атмосферного воздуха.
2 Вопросы защиты атмосферного воздуха, а также снижения объема выбросов и концентрации загрязняющих веществ являются одними из приоритетных для государства. Обеспечение минимизации негативного воздействия на окружающую среду находится на особом контроле у Президента Российской Федерации, в связи с чем был издан Указ Президента Российской Федерации № 204 от 07.05.2018 «О национальных целях и стратегических задачах развития Российской Федерации на период до 2024 года» [2] (далее – Указ № 204).
3 Согласно абзацу 3 подпункта «а» пункта 7 Указа № 204 одной из ключевых целей в сфере экологии, поставленных Правительству Российской Федерации, является достижение к 2024 году кардинального снижения уровня загрязнения атмосферного воздуха в крупных промышленных центрах, в том числе уменьшения не менее чем на 20 процентов совокупного объема выбросов загрязняющих веществ в атмосферный воздух в наиболее загрязненных городах.
4 Во исполнение положений Указа № 204, относящихся к сфере экологии, протоколом от 24.12.2018 № 16 президиума Совета при Президенте Российской Федерации по стратегическому развитию и национальным проектам был утвержден паспорт национального проекта «Экология», который включает в себя реализацию в срок с 01.10.2018 по 31.12.2024 федерального проекта «Чистый воздух» [3]. Впоследствии указанный документ был заменен новым Паспортом, утвержденным Министерством природных ресурсов и экологии Российской Федерации [4].
5 В целях реализации федерального проекта «Чистый воздух» был принят Федеральный закон от 26.07.2019 № 195-ФЗ «О проведении эксперимента по квотированию выбросов загрязняющих веществ и внесении изменений в отдельные законодательные акты Российской Федерации в части снижения загрязнения атмосферного воздуха» [5] (далее – Закон № 195-ФЗ).
6 Эксперимент по квотированию выбросов загрязняющих веществ (за исключением радиоактивных веществ) в атмосферный воздух на основе сводных расчетов загрязнения атмосферного воздуха (далее – эксперимент) направлен на снижение уровня негативного воздействия на окружающую среду и проводится с 1 января 2020 года по 31 декабря 2026 года [6].
7 Между тем, представляется необходимым обратить внимание на тот факт, что деятельность организаций в определенных сферах промышленности напрямую связана с выбросами загрязняющих веществ в атмосферу. Это, в том числе, и организации топливо-энергетического комплекса.
8 Так, например, производство тепловой и электрической энергии на сегодняшнем этапе развития соответствующих технологий невозможно без образования продуктов горения, смол и иных веществ, оказывающих негативное воздействие на окружающую среду. При этом в зависимости от особенностей технологических процессов на объектах, оказывающих негативное воздействие на окружающую среду, выбрасывается различный объем и состав загрязняющих веществ. В то же время деятельность организаций в сфере энергетики является непрерывной, и ее приостановка приведет к отрицательным последствиям не только для самих юридических лиц, но и для населения региона и государства в целом.
