The Legal Regime of Generation Facilities Functioning Based on the Offshore Wind Power Industry (Experience of Foreign States)

The coming decade is of great importance for meeting the objectives of the Paris Agreement provisions on the achievement of global zero emissions by 2050. The key scientific international organizations, e.g., the International Renewable Energy Agency (IRENA), the Ocean Renewable Energy Action Coalition (OREAC) and others have come to the conclusion that it is the offshore wind energy industry that is able to solve the arising tasks by satisfying the current global electricity demand by 18 times. With reference to Russia, one can surely state that the offshore wind energy industry has enormous technical potential of 13.373 GW in its marine territories and water areas. Nevertheless, the modern legislative framework of the Russian Federation is unable to ensure qualitative progress in the development of this renewable energy type. The legal regime of generating facilities functioning based on the offshore wind energy industry is an integral part of the legal regulation of public relations in offshore WPPs. In this respect, the presented article proposes a study of the mentioned aspect taking into account the experience of foreign states that are leaders in the construction and exploitation of offshore WPPs, namely, Germany and Great Britain.

1	2021 год знаменует начало важного десятилетия, которое выводит мировое сообщество на траекторию достижения глобальных чистых нулевых выбросов к 2050 г., установленных в соответствии с Парижским соглашением.
2	Несмотря на то что с момента принятия данного международного документа было проведено достаточно большое количество научных изысканий, направленных на поиск решения поставленных задач, в современный период приоритет остается за офшорной ветроэнергетикой.
3	Офшорная ветроэнергетика выступает основной технологией для доставки крупномасштабной, доступной и безуглеродной энергетики, однако на сегодняшний день потенциал моря практически не затронут, так как установленные офшорные ВЭУ вырабатывают лишь 35 ГВт [1]. В то же время Всемирный банк (The World Bank) оценивает около 71 000 ГВт потенциала стационарных и плавучих офшорных ветроэнергетических установок во всем мире [2].
4	В целом преимущества офшорной ветроэнергетики имеют огромное значение в различных сферах жизнедеятельности. Так, за последние десять лет офшорная ветроэнергетика достигла существенного снижения затрат, при этом нормированная стоимость электроэнергии снизилась почти на две трети, что сделало ее конкурентоспособной по стоимости с ископаемым топливом на энергетических рынках в Европе и Китае [3].
5	Анализ жизненного цикла также показывает, что офшорные ветряные электростанции имеют короткие периоды окупаемости энергии, особенно по сравнению с выработкой на основе ископаемого топлива [4].
6	Принимая во внимание огромный технический потенциал (то есть оценку количества генерирующих мощностей, которые могут быть технически осуществимы, учитывая только скорость ветра и глубину воды) офшорной ветроэнергетики в Российской Федерации, а именно 13,373 ГВт [5], существует необходимость в разработке государственно-правового регулирования данной энергетической отрасли.
7	Неотъемлемой частью быстрого развития офшорной ветроэнергетики выступает полноценное понимание технических вопросов, связанных с офшорными ветряными турбинами, что стимулирует текущие программы исследований и разработок [6]¹.
8	В представленной статье предлагается рассмотреть правовой режим генерирующих ветроустановок, функционирующих на основе офшорной ветроэнергетики, учитывая опыт зарубежных государств, занимающих лидирующие позиции в данном секторе энергетики, а именно Германии и Великобритании.
9	Следует учитывать, что «особенности правового режима энергетических объектов распространяются на весь «жизненный цикл» данных объектов, включая стадии проектирования, строительства, эксплуатации, модернизации, реконструкции, ремонта и вывода из эксплуатации» [7].
10	Но также важными элементами для формирования содержания правового режима генерирующих энергетических объектов являются планирование строительства и получение разрешительных документов, а также подключение к сети.
