Analysis of the Influence of the European Parliament and the Council of the EU Exemplified by the EU Emissions Trading System Reform

Abstract

The article examines the comparative influence of the Council of the European Union and the European Parliament in the ordinary legislative procedure using the example of the EU Emissions Trading System (ETS) reform. The study was carried out on the basis of a process tracing method. Primary data includes documents reflecting positions of the actors (summary of consultations, position papers, statements) and the progress of the legislative process (Commission proposal, EP amendments, discussions in the Council, final text of the directive). In total, 21 important elements of the reform were analysed, on which the positions of the European Parliament and the Council diverged significantly. The following conclusions are made. 1) The case study provides a relevant example of the consensual nature of the EU decision-making. 2) The case study confirms that the essence of the legislative process in the EU is not a confrontation, but an faithful cooperation of both co-legislators. 3) The Commission and both co-legislators were significantly limited by the decision of the European Council, which fixed most of the basic parameters of the ETS phase IV. This corresponds to the trend of new intergovernmentalism. 4) The study of comparative influence of both co-legislators on the final text of the directive demonstrates that the member states played a decisive role in the ETS reform, and the final provisions of the directive reflect primarily the balance of interests and influence in the Council. The study shows how the interests of certain groups of the EU member states, in particular of CEE countries, were taken into account. The influence of the European Parliament on the legislative process is greater than that of individual countries, even the biggest ones, but it is no more than a quarter of the influence of the Council as an actor. 5) The study identifies a number of factors that enable the European Parliament to uphold its position more effectively.

В рамках ИКАО к 2016 г. удалось согласовать создание схемы компенсации и сокращения выбросов углерода для международной авиации (CORSIA, Carbon Offsetting and Reduction Scheme for International Aviation). Участие стран в CORSIA предполагалось добровольным в пилотной (2021–2023 гг.) и начальной (2024–2026 гг.) фазах. В этих условиях на протяжении 2016 г. Комиссия приложила экстраординарные усилия, чтобы убедить максимальное число государств участвовать в CORSIA на добровольной основе. Такое решение приняли более 70 стран, на долю которых приходится свыше 85% международных авиаперевозок. Из крупных стран от этого воздержались Россия и Индия.
1 Функционирование институтов Европейского союза и процесс принятия решений всегда привлекали внимание большого числа исследователей. Теоретическую основу таких работ составляет группа школ, основанных на теории рационального выбора: либеральный межправительственный подход, школа управления, институционализм рационального выбора, различные версии неофункционализма. Альтернативу рационалистическим школам представляет конструктивизм, сторонники которого полагают, что институты ЕС определяют не только поведение, но также предпочтения и даже идентичность акторов.
2 При всем разнообразии рационалистических школ, когда речь заходит о процессе принятия базовых законодательных актов Евросоюза, то есть о формировании или коренном реформировании политики ЕС в какой-либо сфере (policy-setting), основной спор идет между сторонниками либерального межправительственного подхода и неоинституционалистами. Это возвращает внимание исследователя к классическому выбору между межправительственным и коммунитарным методами принятия решения1. 1. В общем случае такое противопоставление не корректно. Европейский союз – слишком сложный и разнородный объект, и потому процесс принятия решений в ЕС не может быть интерпретирован в рамках одной “метатеории” либо дихотомии коммунитарный – межправительственный. Однако, поскольку речь идет о решении системного уровня (учреждение политики, policy-setting), мы вправе ограничиться анализом двух упомянутых противоположных позиций [1].
3 Либеральный межправительственный подход предполагает, что результат законодательного процесса определяется прежде всего позициями и балансом влияния государств – членов ЕС. Новый институционализм объединяет кластер различных подходов, единых в том, что институты ЕС обладают самостоятельностью и существенным влиянием, в частности, на процесс принятия решений.
4 В рамках теории игр обычная законодательная процедура Евросоюза традиционно рассматривается как переговоры по поводу поправок, предлагаемых Европарламентом. Однако сторонники межправительственного подхода напоминают, что Совет ЕС не является единым органом – он обеспечивает площадку для гармонизации интересов стран Союза. Они полагают, что переговоры между государствами-членами в Совете имеют гораздо большее значение, нежели переговоры между Советом и Европарламентом.
5 В последние 20 лет появилось значительное число эмпирических исследований процесса принятия решений в ЕС, в том числе количественных. Они тестируют разнообразные теоретические модели, описывающие процесс принятия решений в ЕС [2, 3, 4].
6 Значительное число эмпирических работ анализирует влияние различных институтов ЕС в процессе принятия решения [5, 6, 7]. Подобного рода анализ проводится на бóльших или меньших массивах данных, в том числе в отдельных сферах деятельности ЕС или прослеживая процесс принятия отдельных документов.
7 Что касается взаимодействия Совета ЕС и Европарламента и их сравнительного влияния в рамках законодательного процесса, то эмпирические исследования дают различные результат. К примеру, С. Мариотто и Ф. Франчино на основе 175 кейсов работы согласительного комитета показали, что итоговые тексты ближе к изначальной позиции Совета, а не ЕП [8]. Р. Томпсон и М. Хосли, проанализировав 162 спорных вопроса из 66 законопроектов, показали, что при использовании процедуры совместного принятия решений (то есть современной обычной законодательной процедуры) влияние Европарламента составляет 25% от влияния Совета. Иными словами, влияние ЕП “равно суммарному [влиянию] двух-трех крупных стран-членов” [7]. Хотя эти работы подтверждают приоритет Совета, в общем виде вопрос остается открытым.
