Abstract

In 1980, German biochemist Barbara Hobom for the first time used the term "synthetic biology" when she described a transgenic bacterium constructed by use of DNA recombinant technology. Actually this direction has become active and has been widely developed only in the last decade. Today, this term is covered by a new branch of research which combines molecular biology and genetic manipulations for construction of new (yet not existing in nature) biologic functions and systems. The rapid growth of research in the field of molecular biology and genetics generates new trends, the development of which contributes to not only improving and expanding the possibilities of using its achievements for the benefit of humankind, but can also be used for illegal purposes. And one of the most vivid and promising trends is a synthetic biology, a new scientific direction in biology that deals with the design and creation of biological systems with prescribed properties and functions that have no analogs in nature. Theoretically, the modern possibilities of synthetic biology are limited only by the availability of a proper material base, the level of preparation and imagination of researchers. Base of state politics in area of chemical and biological safety focused on priority of directions, main tasks and mechanism for prevention of different chemical and biologic threats until 2025 was signed by the Russian president. The main purpose of these documents is a systematic decrease of negative impact of dangerous chemical and biological agents on humans and environment down to an appropriate level. The first Russian monitoring center was included in structure of All –Russian center for medicine of disaster Ministry of Health in January, 2019. The center will collect information about biological threats and analyze possible risks (including capabilities and achievements of synthetic biology). Existing international and Russian legal documents in bioethics issue are not harmonized, but provide a possibility to conduct clinical trials face I-III. Meanwhile, the necessity of further improvements of regulatory framework for the increasingly complex modern biomedical research involving the synthetic biology is obvious.

1 Развитие современных исследований и достижений в области молекулярной биологии и генетики стремительно нарастает. Новые технологии позволяют надеяться на существенные прорывы в области медицины, ветеринарии, растениеводства, в борьбе с эпидемиями и в целом ряде других областей. Вместе с тем эти достижения несут и потенциальные риски, а их неконтролируемое использование может привести к росту опасности применения новых подходов и технологий в противоправных целях. Настоящая работа посвящена рассмотрению правовых и научных аспектов относительно нового направления в биологии – синтетической биологии и анализу ее потенциальных проблем с позиций биобезопасности. Обзор, опубликованный в 2019 г. [1], содержит общую и в то же время довольно подробную информацию о потенциальных биологических угрозах, решении проблем в случае их возникновения, а также возможных путях и способах предотвращения возникающих угроз. В обзоре также обосновывается необходимость информирования с научных позиций тех, кто занимается менеджментом и выработкой соответствующих политических мер и решений на национальном и международном уровнях. Конвенция о запрещении разработок, производства и накопления запасов бактериологического (биологического) и токсинного оружия (КБТО) и об их уничтожении в конце 1971 г. принята Р езолюцией 2826 (XXVI) ГА ООН [2] и вступила в силу 26 марта 1975 г. Срок действия Конвенции не ограничен, ее депозитариями определены Россия (СССР), США и Великобритания. Через 35 лет после ее принятия – в 2011 г., на Седьмой обзорной конференции по Конвенции о запрещении биологического и токсинного оружия государства-участники (а их 173) пришли к соглашению о необходимости участия всех, кто имеет отношение к биологическим наукам, в защите своей работы от злонамеренного использования ее достижений. Важно упомянуть и принятый в январе 2000 г. Картахенский протокол по биологической безопасности, вступивший в силу в сентябре 2003 г. [3] Протокол содержит процедуры, в соответствии с которыми государства должны давать предварительное информированное согласие на первый трансграничный ввоз любого конкретного живого модифицированного организма на их территорию. Этот документ имеет историческое значение, являясь, по сути, первым обязательным международным соглашением, касающимся новых вопросов и проблем в области биологической безопасности. При этом прямых указаний на проблемы, связанные именно с синтетической биологией, он не содержит.
