Аннотация

Понятие «правосудие переходного периода» обычно применяется в контексте постконфликтного урегулирования или в процессе перехода государства от авторитарного режима к демократическому. Существует целый ряд механизмов как правового, так и политического характера, применяемых в ходе осуществления данного вида правосудия. В данной статье рассмотрена деятельность Комиссии по установлению истины, созданной в Бразилии в 2011 г. В ходе постконфликтных судебных и внесудебных процессов гендерно-обусловленное насилие зачастую остается незамеченным. Комиссии по установлению истины являются эффективным механизмом рассмотрения преступлений подобного рода, так как отсутствие формальной процедуры позволяет более гибко реагировать на возникающие вызовы и учитывать интересы потерпевших и свидетелей.
