Abstract

In light of modern processes of development of digitalization of social relations and artificial intelligence, for the effectiveness of the legal regulation system, the need for a new understanding of fundamental general legal categories, which are modified due to their daily digitalization, increases. One of these important categories is legality.

 The purpose of the study is to study the current state and highlight the relationship between the digitalization of law, artificial intelligence and the rule of law in the context of the development of current legislation, as well as to analyze the fundamental scientific concepts regarding the prospects for the digitalization of legal matter.

 The objectives of the study are to analyze the main vectors of development of the process of global cybernization of legal activity, to reveal the conceptual aspects of the introduction of digital technologies and artificial intelligence into the daily qualitative development of legal relations, which significantly affect the state of legality, to reveal the main trends in the development of digitalization of law and artificial intelligence.

Research methods: formal-legal, comparative-historical, structural-analytical, systemic, logical, etc.

The digitalization of law and the emergence of artificial intelligence did not entail changes in law at the level of essence, but at the level of phenomenon, a global fundamental transformation of law as one of the basic social regulators, which has no analogues in the millennia-long history of the development of law, is obvious. This urgently calls for a lot of interdisciplinary research in this area. Digitalization, artificial intelligence and the rule of law are already actively interacting within the current system of positive law. At the same time, the digitalization of law, artificial intelligence and the rule of law are directly interdependent on each other due to fundamental changes in the methods of social communication within the framework of the modern stage of the movement of legal matter. The paper concludes that, despite the development of telecommunication technologies in the context of the interaction of the rule of law and artificial intelligence, instead of conflict, there is access to a new round of the spiral of qualitative dialectical development of legal regulation in general. The final choice within the framework of possible legal behavior remains with the person, who is the subject of law. The author states the tendency for legality to acquire the quality of a digital form, i.e. the emergence of “digital legality”, which in the future may change the basic models of human thinking in the field of law.
