Abstract

The article gives a criminal legal description of the use of prohibited means and methods waging war recognized as an international crime against the peace and security of mankind. The emergence and formation of the doctrine of International Humanitarian Law, the genesis and development of the law of war are shown (special attention is paid to the “Hague law”), the content of the signs of the corpus delicti provided for in Article 356 of the Criminal Code of the Russian Federation is revealed, the shortcomings of the construction of the criminal law norm contained in this article are revealed.
