CRITICAL ANALYSIS OF EXPLANATORY NOTES TO DRAFT LAWS ON THE CRIMINOLOGICAL VALIDITY OF MODERN CRIMINALIZATION

Abstract

The requirement of criminological validity of criminalization acts, put forward by the doctrine, presupposes the presentation in the explanatory note to the relevant draft law of data confirming the existence of grounds and conditions for making a specific act criminally unlawful. An appeal to the explanatory notes for the period 2009-October 2023 shows that a significant part of the newly introduced criminal law prohibitions can be attributed to unfounded or insufficiently justified. Based on the analysis of the practice of their application, it follows that the criminological validity of the novel is one of the important conditions for the relevance of the norm in practice, however, not the only one.
