Abstract

The reviewed publication is devoted to the analysis and disclosure of the key characteristics of the amendments and additions made to the Constitution of the Russian Federation in 2020.On the basis of modern ideas about the most important public relations, the norms, institutions and spheres of social life affected by these constitutional amendments are systematically and consistently characterized in the work. The structure of the work includes not only the author's general com-ments and the legal positions of the Constitutional Court of the Russian Federation concerning the relevant blocks of constitutional amendments, but also the presentation of the scientist's views on a number of the most complex debatable issues of the current state and trends in the modernization of the elements of Russian constitutionalism affected by the amendments. This approach ensures a high academic level of the presented material.

1 2020-й год, наверняка, запомнится гражданам России прежде всего как год конституционных преобразований, внесения обширных и значимых изменений в Конституцию РФ. Их направленность на укрепление государственного единства и целостности Российского государства, повышение уровня социальной защищенности человека и гражданина, закрепление в качестве непререкаемых ценностей и приоритетов семьи, материнства, отцовства и детства, совершенствование сложившейся системы институтов публичной власти именно в этот период приобрела особую актуальность, выкристаллизовалась на фоне усилившихся глобальных и внутренних вызовов.
2 В политико-правовом плане по-разному можно квалифицировать конституционные перемены 2020 г. Нередко они определяются в научной литературе как конституционная реформа1, хотя далеко не всегда это подтверждается какими-либо (тем более – убедительными) аргументами. Нет сомнений, что сам по себе текст Конституции 1993 г. претерпел в 2020 г. существенное обновление. Но приведет ли все это к конституционной реформе? Вопрос, как представляется, принадлежит будущему, возможно, даже ближайшему, связанному с перспективами реальных преобразований в обществе и государстве, которые должны быть проведены на основе обновленного текста Конституции. В этом плане весьма примечательным и позитивным является тот факт, что в новой книге проф. Н.М. Добрынина, где дан широкий, всесторонний анализ конституционных новелл 2020 г., эти процессы не квалифицируются как конституционная реформа. Это тем более важно, если иметь в виду, что анализируемый научный труд (который сам автор скромно определил как учебно-методическое пособие) адресован прежде всего студентам, аспирантам, преподавателям, ориентирован на учебный процесс. 3 Особо подчеркнем, что среди обилия учебной литературы и других публикаций, адресованных студентам и аспирантам, а также практическим работникам, учебно-методическое пособие «Конституция России: настоящее и будущее», подготовленное Н.М. Добрыниным специально в целях изложения и обсуждения принятых в 2020 г. конституционных поправок, отличается оригинальностью структуры и умелой методической компоновкой основного и вспомогательного материала. Работа автора выделяется в общем ряду также и тем, что это одна из первых книг, посвященных осмыслению и представлению в виде доступного учебно-методического пособия всего содержательного среза последних конституционных поправок — в их неразрывной системной взаимосвязи и ценностном контексте с другими положениями Конституции РФ, которые остались неизменными, а также в органическом единстве с оценками соответствующих новелл Конституции, которые были даны Конституционным Судом РФ, прежде всего в его Заключении от 16 марта 2020 г.
