Legal regulation: concept and forms

Legal regulation by law belongs to the basic legal categories and permeates the entire legal conceptual apparatus. At the same time, in the domestic science of legal theory, the term "legal regulation" is often used in a certain commonly used, rather than specifically legal sense. Scientific conceptualization of this legal phenomenon has not yet been made, it is usually considered through the construct of the mechanism of legal regulation. But the phenomenon of legal regulation is much broader than its dynamic, mechanistic side and requires not only clarification of its static features, features and specific characteristics, but also types, types, methods, means and forms. The theoretical and legal doctrine contains minimal information about the forms of legal regulation, which is a significant cognitive gap. The purpose of the article is to define modern approaches to understanding and defining legal regulation and its forms. To achieve this goal, we used General scientific methods of dialectical and formal logic, analysis, synthesis, definition and classification of legal phenomena, methods of ascent from the abstract to the concrete, from the concrete to the abstract, as well as legal-dogmatic, historical-legal and legal-hermeneutical private law methods of cognition. It is concluded that it is necessary to move away from the conservative Soviet and early post-Soviet view of legal regulation as a sphere of activity exclusively for state authorities. Forms of legal regulation depend on the subject of rule-making: international law, state law, local (corporate), supranational, including "soft law".
