Abstract

The article substantiates the expediency of introducing such a category as "criminal misdemeanor" into the criminal code of the Russian Federation. The purpose of the research is a comprehensive analysis of the resolution of the Plenum of the Supreme Court of the Russian Federation concerning the implementation of the legislative initiative to introduce criminal misconduct. The article notes that the application of incentive rules on exemption from criminal liability should be unconditional, exclusive and justified by various circumstances. It is noted that art. 75, 76, 90 of the criminal code of the Russian Federation are sufficient means of humanizing criminal legislation. The author does not share the proposal to introduce other measures of a criminal nature in the form of correctional and mandatory labor applied to the released person, due to their uniformity with the same types of punishments. Despite criticism of a number of provisions of the resolution of the Plenum of the Supreme Court of the Russian Federation, it is proposed to introduce a new category of crime in the criminal code in order to deepen the differentiation of criminal responsibility.
